ENVIRONMENTAL,CHECKLIST 4.7 HAzARDs DISCUSSION REGARDING PROPOSED PROJECT a) Create a significant hazard to the public or the environinent through the routine transport, use, or disposal of hazardous m&erld i? During construction of the proposed project,hazardous materials would be.transported " through the project area. Constriction activities fypically'invaive the use of potentially toxic substances such as paints, fuels, and solvents. People living in neighborhoods near the proposed project could be exposed to these materials as trucks move through'their neighborhoods during construction•at the project site.`. Conistmktion.activities would be subject to federal,state, and local laws and requirements designed to.minimize and avoid the potential health and safety risks associated.with hazardous-materials.:Furthermbre, Mitigation Measure 4.9-1 in SPIIIEIR adequately mitigates-these�potential impacts. Given these controls, impacts related to the transport, use, or storage of hazardous materials would be less than significant. Mitigation Measures No mitigation measures are required. b) Create a significant hazard to the public or the environment through reasonably foreseeable upset and accident conditions involving the release of hazardous materials into the environment? The project site was formerly used for dry farming. The SPIREIR identified the agricultural chemicals used within the Specific Plan III area over the years and indicated that most of these chemicals have half-lives less than 14 days after application with the exception of paraquat, which has a half-life of more than 1,000 days (23/4 years) (EDAW,2005b). In addition,the MEIR identifies organophosphorus as a possible agricultural chemical with a long decay time, and that application should cease several months to two years prior to construction of houses at Mountain House Community. In addition, it is possible that other potentially hazardous materials could be disturbed or handled during construction of the proposed project. Lead-based paint and asbestos materials could be found at the existing residence on the west side of the project site. These materials should be removed for proper disposal prior to demolition of the buildings. There is a well and a septic tank at the existing residence on the west side of the project site. The well should be abandoned in conformance with California Department of Health requirements, and the septic tank should be abandoned in conformance with SJCEHD requirements. SPIIIEIR Mitigation Measure 4.9-1 is summarized above. Specific Plan III Implementation Measure 6.7.4.3 (d) requires corrective action for the presence of any fuel,pesticide, herbicide,or chemical residue on or under the soil in excess of allowable amounts that are listed on state or federal lists of toxic materials (EDAW, 2005a). Corrective actions shall be conducted in accordance with requirements of the SJCEHD and the applicable state agency. These mitigation and implementation measures adequately define the actions to be taken to eliminate these hazards that would result in impacts that are less than significant. 4-37
