LFR Inc. <br /> complies with requirements of the most recently revised version of ASTM Standard <br /> Practice E 1527 and the US EPA AAI Rule. <br /> This report has been prepared for the review of legal counsel, and was prepared <br /> pursuant to the Consulting Services Agreement between JLH Realty and Construction, <br /> Inc. dba John Laing Homes and LFR Inc. dated October 2006 (the "Agreement"). <br /> LFR's performance of the Services is specifically intended to develop information <br /> which Company's counsel will use in advising Company of its legal rights and/or in <br /> advancing its interests in litigation. <br /> 2.2 Detailed Scope of Services <br /> The Phase I ESA conducted by LFR included, but was not limited to, the <br /> following services: <br /> • a reconnaissance-level visit of the Site for evidence of the release(s) of hazardous <br /> materials and petroleum products and to assess the potential for on-site releases of <br /> hazardous materials and petroleum products <br /> • drive-by observations of adjacent properties and the site vicinity <br /> • interviews with people familiar with the Site ?j. I <br /> • review of regulatory agency files \ <br /> • review of historical documents <br /> • limited soil sampling activities <br /> • preparation of a report presenting our findings including summary of conclusions <br /> and recommendations <br /> 2.3 Significant Assumptions <br /> The purpose of this Phase I ESA is to provide appropriate inquiry into the previous <br /> ownership and use of the Site consistent with good commercial and customary practice <br /> in an effort to minimize liability. LFR also assumes that the information provided by <br /> the Client, regulatory database provider, and regulatory agencies is true and reliable. <br /> 2.4 Limitations and Exceptions <br /> The opinions and recommendations presented in this report are based upon the scope of <br /> services, information obtained through the performance of the services, and the <br /> schedule as agreed upon by LFR and the original party for whom this report was <br /> originally prepared. This report is an instrument of professional service and was <br /> prepared in accordance with the generally accepted standards and level of skill and care <br /> under similar conditions and circumstances established by the environmental consulting <br /> industry.
