A copy of the Environmental Lien Report is included as Appendix A. 3.5 Current Uses of the Site The Site is currently vacant undeveloped land. �U"1'n 4.0 USER-PROVIDED INFORMATION The following items regarding the Site were provided by the Client. The User Provided Information Questionnaire, per ASTM Practice E 1527-05 guidelines, is attached in Appendix B. However, wherever the US EPA AAI rule permits either the Environmental Professional or the report user to conduct inquiry, that inquiry has been performed by LFR and the Client provided materials and these questionnaires constitute only a part of that inquiry. 4.1 Title Records Title Records were not provided by the Client. An Environmental Lien Report was ordered and provided by EDR, Inc. According to the report, ownership of the Site is vested as follows: • Parcel Nos. 070-560-47 and 070-570-13 (Windmill Park Stockton, LLC as of 2003) • Parcel No. 070-140-10(Larne Schmidt, Jerry Schmidt and Barrie Schmidt as of 1998) • Parcel No. 070-140 28 bert and Lorraine Schmidt as of 1991) 4.2 Environmental Liens or Activity and Use Limitations LFR provided JLH Realty and Construction, Inc. dba John Laing Homes (JLH) a User Questionnaire with the following questions as part of the assessment. The User / Questionnaire was completed by Mr. Frank Rubino, Partner associated with the Site for the past 30 years: • Was he aware of any environmental cleanup liens against the property that are filed or recorded under federal, tribal, state or local law? • Was he aware of any activity or land use limitations, such as engineering controls, land use restrictions or institutional controls that are in place at the site and/or have been filed or recorded in a registry under federal, tribal, state or local law? 00��_L.werSacra WRoad_n.Hl s_P6asa I ESA:om Page 7
