k <br /> r \ <br /> 2. CALIFORNIA DEPARTMENT.OFFISH AND GAME <br /> a. All construction shall be conducted during daylight hours. <br /> t <br /> b. The inlettoutlets shall allow water to flow freely. <br /> c. If project construction is to begin during the nesting season of the tri-colored blackbird (March 1 <br /> September 15),'all suitable nesting habitat on the project site and within 500 feet of the limits of <br /> work shall be surveyed by a qualified biologist prior to initiating construction-related activities. <br /> Surveys shall be.conducted no more than 14 days prior to the start of work. <br /> d. If tri-colored blackbird (nesting areas are identified, a setback of 500 feet from colonial nesting <br /> areas shall be established and maintained during the nesting season for the period <br /> encompassing nest building and continuing until fledglings leave nests. This setback applies <br /> whenever construction or other ground-disturbing activities must begin during the nesting season <br /> in the presence of nests which are known to be occupied. Setbacks shall be marked by brightly <br /> colored temporary fencing. <br /> e. Removal of suitable nest trees for the Swainson's hawk shall be completed during the non_ <br /> nesting season (when the nests'are unoccupied), between September 1•and.February 15. <br /> f. If suitable nest trees for the Swainson's hawk will be retained and ground disturbing activities will <br /> commence during the nesting season (February 16 through August 31), all suitable nest trees on <br /> the site will be surveyed by a qualified biologist prior to initiating construction-related activities. <br /> Surveys will be conducted no more than 14 days prior to the start of work..If an active nest is <br /> discovered, a 100-foot buffer.shall be established around the nest tree.and delineated using <br /> orange construction fence or equivalent. The buffer shall be maintained in place until the end of <br /> the breeding season or until the young have fledged, as determined by a qualified biologist. If no <br /> active nests are present, construction may proceed as planned. <br /> g. In some instances, CDFG may approve decreasing the specified buffers for the Swainson's hawk <br /> with implementation of other avoidance and minimization measures (e.g., having a qualified <br /> biologist on-site during construction activities during the nesting season to monitor nesting <br /> activity). If no nesting is discovered, construction can begin as planned. Construction beginning <br /> during the non-nesting season and continuing into the nesting season shall not be subject to <br /> these measures" <br /> h. Preconstruction surveys for Pacific pond turtle shall be conducted no more than 14 days prior to <br /> project construction. <br /> i. If nesting areas for pond turtles are.identified on the project site, a buffer area of 300 feet shall be <br /> established between the nesting site and the wetland located near the nesting site. These buffers <br /> shall be indicated by temporary-fencing if construction has or will begin before nesting periods are <br /> ended (the period from egg laying to emergence of hatchlings is normally April to November). <br /> j. Avoid construction activities within 200 feet of the banks of giant garter snake aquatic habitat. <br /> Confine movement of heavy equipment to existing roadways to minimize habitat disturbance. If <br /> work activities require construction equipment use within 200 feet of the banks of giant garter <br /> snake aquatic habitat, a qualified biological monitor will be on-site to monitor the work activity. <br /> k. Construction activity shall occur during the active period for the giant garter snake, between May <br /> 1 and October 1. Between October 2 and April 30 contact the Service's Sacramento Fish and <br /> Wildlife Office to determine if additional measures are necessary to minimize and avoid take. <br /> Conditions of Approval - 3 - PA-0700074 <br />
