CALIFORNIA ENDANGERED SPECIES ACT: In carrying out the operations of the project, the <br /> applicant shall take no action that violates the provisions of the California Endangered Species Act or <br /> any other laws or regulations pertaining to the protection of the Suisun marsh aster, rose mallow, <br /> Delta tule pea, tricolored blackbird, ferruginous hawk, mountain plover, greater sandhill crane, prairie <br /> falcon, Swainson's hawk, white-tailed kite, western burrowing owl, Cooper's hawk, loggerhead <br /> shrike, yellow-breasted chat, Pacific pond turtle, giant garter snake, Delta smelt, Central Valley <br /> steelhead, and the Central Valley fall-run Chinook salmon. Compliance with said laws shall be the <br /> sole responsibility of the applicant, and the applicant agrees to indemnify, defend, and hold the <br /> County harmless from and against any claim or action by affected State agencies as to the project's <br /> compliance with said laws. <br /> (1) As a condition of project construction, the following shall be implemented: <br /> A. Before excavation or construction activities, the boundaries of the project area shall be <br /> delineated by flagging, or other means, to prevent workers or equipment from working <br /> outside the right-of-way. <br /> B. Access routes, staging areas, and total area of activity shall be limited to the minimum <br /> necessary to achieve the project goal. All workers shall be notified of the appropriate <br /> access routes, staging areas, and total area of the activity. These areas shall be clearly <br /> marked. <br /> C. . Ground disturbance and vegetation removal shall be limited during construction. <br /> D. Work shall be suspended during periods of heavy rain. <br /> E. All areas with exposed soil will be revegetated as soon as practicable. <br /> i.
