The property shall transfer to a zone within CSA 41 prior to approval of the Improvement Plans to <br /> provide for the operation, maintenance, and improvement of street lighting and storm drainage <br /> facilities. A new assessment for the zone shall be approved by the property owners prior to <br /> approval of the Improvement Plans. The assessment for the new zone shall be based on the <br /> cost for maintenance, operation, system improvements, and any replacement program of facilities <br /> within CSA 41. The applicant shall pay for the cost to process-the transfer and assessment for <br /> the new zone. In addition, the applicant shall pay for the maintenance and operation of the <br /> system from the time the facilities are accepted by the District until the transferred area is placed <br /> on the assessment role of the District. Written confirmation is required from the City of Stockton (East Stockton SSP) that improvements <br /> have been constructed or financial arrangements have been made for any improvements for <br /> public sewer required by the agency. In addition, written confirmation from the City of Stockton <br /> (East Stockton SSP) that the agency has or will have the sewer capacity to serve the <br /> development is also required (Development Title Section 9-1100.3) <br /> b. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, <br /> or employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning a subdivision, which action is brought within <br /> the time provided for in Section 66499.37 of the Government Code. <br /> 5. This project is subject to the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP). At the time of development, any structures that require ground <br /> disturbance on this or subsequent divided parcels will be subject to participate in the SJMSCP <br /> and should be resubmitted to the San Joaquin Council of Governments to ensure biological and <br /> mitigation obligations are satisfied. The following note shall be recorded as a Notice of Minor <br /> Subdivision Restriction: <br /> Parcels 1 through 11 are subject to the San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP).
