• This finding can be made because the Initial Study prepared for this project did not <br /> identify any known rare or endangered species or habitats or other substantial <br /> environmentally adverse effects. <br /> 6. The design of the subdivision or type of improvement is not likely to cause significant public health <br /> problems. <br /> • This finding can be made because the subdivision will be served by public waste <br /> water treatment, public water, and public storm water drainage through an on-site <br /> detention basin to be dedicated to County Service Area No. 41. <br /> 7. The design of the subdivision or the types of improvements will not conflict with easements <br /> acquired by the public at large for access through or use of property within the proposed <br /> subdivision <br /> • This finding can be made because there is an existing storm drain easement along <br /> the western property line of the project site to access Mormon Slough. The storm <br /> water detention basin will have direct access for a public utility and storm drain <br /> easement along the western property line of Lot 9. <br /> 8. Any land or improvements to be dedicated to the County or other public agency is consistent with <br /> the General Plan, any applicable Specific Plan and Special Purpose Plan, and any other <br /> applicable plan adopted by the County. <br /> • This finding can be made because the land to be dedicated to the County for the <br /> detention basin (Lot A) is consistent with the General Plan. There are no Specific <br /> Plans, Special Purpose Plans, or other applicable plans. <br /> 9 The design of the subdivision provides, to the extent feasible, for future passive or natural heating <br /> or cooling opportunities in the subdivision, as required by Government Code Section 66473.1 <br /> • This finding can be made because the lots are large enough so that individual <br /> dwellings can be situated to take advantage of solar orientation. <br /> San Joaquin County PA-0600119Wffordable Luxury Homes <br /> Community Development Page 6 <br />
