SAN JOAQUIN COUNTY <br /> -� c:<COMMUNITY DEVELOPMENT DEPARTMENT <br /> • �1810 E.HAZELTON AVE..STOCKTON,CA 85205-5232 <br /> <)'F1ppYPHONE:208/488-3121 FAX:208/458-3183 <br /> March 24, 2006 <br /> MEMORANDUM <br /> TO: Development Committee <br /> FROM: Mo Hatef, Assistant Planner <br /> SUBJECT: MAJOR SUBDIVISION APPLICATION PA-0600119 OF AFFORDABLE LUXURY <br /> HOMES (C/O WONG ENGINEERS) (APN: 157-140-17, 53) (ADDRESS: 3924 <br /> EAST GUERNSEY AVENUE, STOCKTON) <br /> The applicant has submitted the above referenced Major Subdivision Application to subdivide <br /> 3.82 acres into eleven (11) residential lots. <br /> The project site is located at the southeast corner of Hinkley Avenue and Guernsey Avenue, east <br /> of Stockton. <br /> The property has a General Plan designation of R/L (Low Density Residential) and is zoned R-L <br /> (Low Density Residential). <br /> The Community Development Department has reviewed the application and offers the following <br /> comments: <br /> Background <br /> In 1990, a Major Subdivision (SU-91-8) was applied for to subdivide the largest parcel and the <br /> adjacent parcel to the west into thirty-eight (38) residential lots. This application was approved by <br /> the Planning Commission in March 1991 but expired in March 1996. In August of 2000, a Minor <br /> Subdivision was approved that created the current configuration of the parcel. <br /> Riparian Habitat <br /> The Mormon Slough is adjacent to the southern boundary of the project site. Development Title <br /> Section 9-1510.5 states that parallel to any natural bank of a waterway, a natural open space for <br /> riparian habitat and waterway protection shall be maintained to provide nesting and foraging <br /> habitat and the protection of waterway quality. The minimum width of said open space shall be <br /> one-hundred (100) feet, measured from the mean high water level of the natural bank or fifty (50) <br /> feet back form the existing riparian habitat, whichever is greater. Water-dependent uses may be <br /> permitted in this buffer. The setback line needs to be shown on the Final Map. The applicant <br /> must also show any existing riparian habitat on the Final Map. <br /> 1 <br />
