WHEREAS, Owner owns that certain real property located in the unincorporated <br /> community of Linden in the County of San Joaquin, California, and more particularly shown as <br /> Lot"4"on Exhibit A, attached hereto and incorporated herein. <br /> B. WHEREAS, Owner also owns that certain real property located in the <br /> unincorporated community of Linden in the County of San Joaquin, California, and more <br /> particularly shown as Lot"1"on Exhibit A, attached hereto and incorporated herein. <br /> C. WHEREAS, On February 7, 2013 San Joaquin County approved Major <br /> Subdivision Application No. PA-1200230 authorizing the subdivision of land shown on Exhibit <br /> A into 10 Lots and a"Designated Remainder". <br /> D. WHEREAS, Condition Le. of the"Major Subdivision" requires"An <br /> Improvement Plan application for the Nursery Sales and Services, Wholesale operation, on <br /> Parcel 1 shall be approved and finalized prior to the recordation of the Final Map". <br /> E. WHEREAS, The improvements required on Lot 1 of the Major Subdivision will <br /> use water from a existing well located on Lot 4 of the Major Subdivision depicted on Tentative <br /> Subdivision Map attached hereto and incorporated herein as Exhibit A. <br /> F. WHEREAS, California Civil Code Section 805 states: "A servitude thereon <br /> cannot be held by the owner of the servient tenement". <br /> G. WHEREAS, Because Owner owns Lot 1 shown on Major Subdivision (the <br /> proposed dominant tenement) and Lots 2 though 4 shown on Major Subdivision(the proposed <br /> servient tenement), California Civil Code Section 805 precludes Owner form creating an <br /> easement between the parcels unless and until Owner sells, gifts, transfers, or otherwise alienates <br /> one of the parcels. <br /> t <br />
