WHEREAS, Owner owns that certain real property located in the unincorporated <br /> community of Linden in the County of San Joaquin, California, and more particularly shown as <br /> Lot"4"on Exhibit A, attached hereto and incorporated herein. <br /> B. WHEREAS, The improvements required on Lot 1 of the Major Subdivision will <br /> use water from a existing well located on Lot 4 of the Major Subdivision depicted on Tentative <br /> Subdivision Map attached hereto and incorporated herein as Exhibit A. <br /> F. WHEREAS, California Civil Code Section 805 states: "A servitude thereon <br /> cannot be held by the owner of the servient tenement". <br /> G. WHEREAS, Because Owner owns Lot 1 shown on Major Subdivision (the <br /> proposed dominant tenement) and Lots 2 though 4 shown on Major Subdivision(the proposed <br /> servient tenement), California Civil Code Section 805 precludes Owner form creating an <br /> easement between the parcels unless and until Owner sells, gifts, transfers, or otherwise alienates <br /> one of the parcels. <br /> t <br />
