H. WHEREAS, In order to satisfy County's concerns regarding future access to <br /> existing well while at the same time complying with California Civil Code Section 805, Owner <br /> executes this Notice. <br /> NOW THEREFORE: <br /> 1. The Recitals above are incorporated herein and made a part hereof.. <br /> 2. If at any point prior to the Major Subdivision expiring, becoming invalid, or <br /> otherwise ceasing to require access across the Lot 1, Owner sells, grants, transfers, or otherwise <br /> alienates Lot 1 independent of Lots 2 through 4, at time of such sale, grant transfer, or alienation, <br /> Owner shall reserve or otherwise create a right-of-way easement across Lots 2 through 4, <br /> sufficient to accommodate a water pipeline across Lots 2 through 4 as shown on Exhibit A and <br /> as would be more particularly described at that time ("Future Water Line Easement"). <br /> 3.
