MOUNTAIN HOUSE NEIGHBORHOODS K AND L INITIAL STUDY 5.ENVIRONMENTAL CHECKLIST <br /> 3.AIR QUALITY AND GREENHOUSE GAS EMISSIONS <br /> F1 <br /> Fireview and planning activities. In 2001,the SJVAPCD revised its Regulation VIII- <br /> Fugitive PM Prohibitions, in response to commitments made in the 1997 PM10 <br /> Attainment Plan to incorporate best available control measures (BACM). <br /> Regulation VIII consists of a series of dust control rules that emphasize reducing <br /> fugitive dust as a means of achieving attainment of the federal standards for <br /> PM10. <br /> Fill <br /> Also, District Rule 9510 Indirect Source Review(ISR)was adopted December <br /> 15,2005. ISR was adopted to fulfill the SJVAPCD's emission reduction <br /> commitments in the PM10 and Ozone Attainment Plans ISR requires submittal <br /> of an Air Impact Assessment(AIA)application no later than the date on which <br /> application is made for a final discretionary approval from the public agency. The <br /> AIA will be the information necessary to calculate both construction and <br /> operational emissions of a development project. The proposed Neighborhoods K <br /> and L project qualifies as a development project under Rule 9510 because it <br /> contains more than 50 residential units. <br /> d �} <br /> p Section 6.0 of the rule outlines general mitigation requirements for developments <br /> that include reduction in construction emissions of 20 percent of the total <br /> construction NOx emissions, and 45 percent of the total construction PM10 <br /> exhaust emissions. Section 6.0 of the rule also requires the project to reduce <br /> operational NOx emissions by 33.3 percent and operational PM10 emissions by <br /> k 50 percent. Section 7.0 of the rule includes fee schedules for construction or <br /> F14 <br /> operational emissions of NOx or PM10 in excess of those emission goals <br />' identified in Section 6.0 of the rule. Section 7.2 of the rule identifies fees for <br /> excess emissions that are$9,350 per ton for NOx emissions for year 2008 and <br /> beyond, and $9,011 per ton for PM10 emissions for year 2008 and beyond. <br /> SJVAPCD also adopted Regulation 4901 to control wood-burning emissions from <br /> new residential development. Regulation 4901 prohibits wood-burning fireplaces <br /> within new residential development and limits the number of wood-burning <br /> heaters or stoves that can be constructed. The limit on wood-burning devices is <br /> partially based on the density of development, as follows: <br /> ■ No person shall install a wood-burning fireplace in a new residential <br /> development with a density greater than two dwelling units per acre. <br /> ■ No person shall install more than two Phase 11 Certified wood-burning <br /> heaters per acre in any new residential development with a density equal to <br /> or greater than three dwelling units per acre. <br /> Fi ■ No person shall install more than one wood-burning fireplace or wood <br /> burning heater per dwelling unit in any new residential development with a <br /> density equal to or less than two dwelling units per acre. <br /> CEQA Guidance Document <br /> In 1998, the SJVAPCD adopted a formal guidance document containing the <br /> District's recommendations for preparing CEQA documents.
