<br />` f" The property owner is solely responsible for notifying all governmental agencies, and the public at large,
<br /> of the existence, release, treatment, or disposal of any hazardous materials observed at the project Site,
<br /> either before or during performance of Condor's services. Condor assumes no responsibility or liability
<br /> whatsoever for any claim, loss of property value, damage, or injury which results from pre-existing
<br /> hazardous materials being encountered or present on the projcct' Site, or from the discovery of such
<br /> hazardous materials.
<br /> Condor, as an independent contractor, has completed the ASTM Phase I ESA in accordance with the ,
<br /> ASTM guidelines and with the customary state of the practice and the prevailing standard of care for
<br /> completing such assessments in California at this time. Condor shall not be subject to any express or
<br /> implied warranties whatsoever.
<br /> This report and other instruments or services are prepared and made available for.the sole use of the .
<br /> officers and representatives of the Client. The contents thereof may not be used or relied upon by any
<br /> other person(s)without the express written consent and authorization of the Client and Condor.
<br /> 1.5 SPECIAL TERMS AND CONDITIONS

<br /> 2..0 SITE DESCRIPTION
<br /> The remainder of this section provides a brief description of the Site and surrounding areas. More
<br /> information regarding the Site and its description, including historical data, is included in Sections 4.0
<br /> and 5.0.
<br /> 2.1 SITE LOCATION AND LEGAL DESCRIPTION
<br /> The Site is located approximately 6.2 miles northwest of Tracy, California, and is shown on the Clifton
<br /> Court Forebay, California, United States Geological Survey(USGS) 7.5-Minute Topographic Map, dated
<br /> 1978, in Sections 3, 4, 9, and 16, Township 2 South, and Range 4 East and in Sections 33 and 34,
<br /> Township 1 South, and Range 4 East, Mount Diablo Base and Meridian. The Site properties are
<br /> designated by APNs 209-030-03 and —04; 209-040-09, -14, and —17; 209-050-09; 209-170-02; and 209-
<br /> 450-11, -12, and-13 (as shown on Figures 3A through 3D in Appendix A) and consist of approximately
<br /> 1,195 acres total.
<br /> Old River is located along the northern boundaries of Neighborhoods K and L. Mountain House Creek is
<br /> located in the western portion of Neighborhood L and Wicklund Cut is located along a portion of the
<br /> eastern boundary of.Neighborhood L. The Union Pacific Railroad tracks are located along the southern
<br /> boundary of Neighborhood L. Byron-Bethany Road/State Route 33 (Byron Road), south of the railroad
<br /> tracks, is located along the northern boundary of the Town Center. Grant Line Road is located along the
<br /> southern boundary of Neighborhood D. The Alameda-San Joaquin County Line is located.approximately
<br /> 4,000 feet west of the Site properties. Clifton Court Forebay is located approximately 1.8 miles northwest
<br /> of the Site.Highway 205 is located approximately one mile south of the Site. .
<br /> 2.2 PHYSICAL SETTING AND SOURCES
<br /> The sources used for determining the physical setting of the Site were the EDR report (Appendix C), and
<br /> the USGS Clifton Court Forebay, California 7.5-Minute Topographic Quadrangle Map, dated 1978
<br /> (Appendix F). The average Site elevation for Neighborhood D is approximately 90 feet above mean sea
<br /> level (ms]), for Neighborhood K approximately 10 feet above msl, for Neighborhood L approximately 18
