Phase I Environmental site Assessment <br /> f Neighborhoods D,K,L,and Town Center,Mountain House,California <br /> Page 4 <br /> Listings in publicly available records that do not have to be located geographically are not generally <br /> practically reviewable. For large databases with numerous facility records (such as RCRA hazardous <br /> waste generators and registered underground storage tanks), the records are not practically reviewable <br /> unless they can be obtained from the source agency in the smaller geographic area of zip codes. Even <br /> when information is provided by zip code for some large databases, it is common for an unmanageable <br /> number of sites to be identified within a given zip code. In these cases, it is not necessary to review the <br /> impact of all the sites that are likely to be listed in any given zip code; that information would not be <br /> practically reviewable. In other words, when so much data is generated that it cannot be feasibly reviewed <br /> for its impact on the property, it is not practically reviewable. <br /> ASTM 3.3.29 Publicly available — Information that is publicly available means that the source of the <br /> information allows access to the information by anyone upon request. <br /> ASTM 3.3.30 Reasonably ascertainable -- For purposes of both this practice and Practice E 1528, <br /> information that is (1)publicly available, (2) obtainable from its source within reasonable time and cost <br /> constraints, and (3)practically reviewable. <br /> ASTM 3.3.43 Visually and/or physically observed-- During a Site visit pursuant to Practice E 1528, or <br /> pursuant to this practice, this term means observations made by vision while walking through a property <br /> and the structures located on it and observations made by the sense of smell, particularly observations of <br /> noxious or foul odors. <br /> 1.4 USER RELIANCE,LIMITATIONS, AND EXCEPTIONS <br /> _ The scope of this project was presented in our proposal dated October 18, 2004, and work order <br /> agreement 4125KI dated October 20, 2004, and subsequently approved by the Client. Condor performed <br /> this environmental assessment in accordance with the guidelines set forth in the ASTM E-1527-00. The <br /> scope of work did not include other services that are not described in this report. Specifically excluded <br /> t from the scope of work are (1) the evaluation of the Site for the presence of asbestos, radon, mold, and <br /> lead-based paint, (2) a survey of the Site for wetlands or rare and endangered species, (3) a survey of the <br /> Site for historical or cultural resources, and(4)research into the title history of the Site. <br /> This ASTM Phase I ESA is thorough,but is not intended to identify all potential concerns, or to eliminate <br /> all risk of the subject properties bearing some degree of environmental liability. Condor cannot and will <br /> not warrant or certify that the Site is free of contaminants because it is impossible to know if such a <br /> condition'exists. Although risks can never be eliminated, more detailed and extensive investigations yield <br /> more information. This information may help you better manage your risks. Such detailed services <br /> involve greater expense. We ask our clients to participate in identifying the level of service that will <br /> provide them with an acceptable level of risk. <br /> Land use, Site conditions (both on-site and off-site), and other factors will change over time. Site <br /> activities and regulations beyond Condor's control could change at any time after the completion of this <br /> report. Our observations, findings, and opinions can be considered valid only as of the date of the Site <br /> visits/reconnaissance, November 12 and 15, 2004. If any changes are made or errors found in the <br /> information used for this report, the interpretations and conclusions contained herein shall not be <br /> considered valid unless the.changes or errors are reviewed by Condor and either appropriately modified <br /> or re-approved in writing. This report should not be relied upon after 180 days from the date of issuance <br /> (ASTM E-1527-00, Section 4.6). <br /> ow - <br /> La CONDO <br />
