The property shall transfer to a zone within County Service Area No. 49 prior to approval <br /> of the Improvement Plans to provide for the operation, maintenance, and improvement of <br /> street lighting facilities. A new assessment for the zone shall be approved by the property <br /> owners prior to approval of the Parcel Map. The assessment for the new zone shall be <br /> based on the cost for: maintenance, operation, system improvements, and any <br /> replacement program of facilities within CSA 49. The applicant shall pay for the cost to <br /> process the transfer and assessment for the new zone. In addition, the applicant shall pay <br /> for the maintenance and operation of the system from the time the facilities are accepted <br /> by the District until the transferred area is placed on the assessment role of the District. <br /> (Development Title Section 9-1100.5) <br /> 7. The map improvement plan shall delineate the unnamed drainage ditch on lots 43, 48, and <br /> 59 with a 25-foot building setback from the banks of the ditch. <br /> 8. The applicant shall keep the unnamed drainage ditch free of all obstacles which impede <br /> the flow of water, and any alteration to the unnamed drainage ditch will require obtaining <br /> a Watercourse Encroachment Permit from the County of San Joaquin Public Work <br /> Department. <br /> 9.
