B. The proposed zone district is reasonable and beneficial at the time.
• The proposed Zone Reclassification for the 54.9 acre portion of the parcel is reasonable
and beneficial at this time as the site is not productive farmland and is adjacent to existing
industrial operations. The remaining 67.65 acres of the subject parcel is currently zoned
for and developed with industrial uses. The zone reclassification will bring consistency to
the parcel zoning. The adjacent properties to the north are currently zoned AG-40, and the
adjacent properties to the east, west, and south are in the City of Tracy.
Agricultural Mitigation
This project includes a Zone Reclassification application that proposes to change the permitted land use from
an agricultural to a nonagricultural land use. Pursuant to Development Title Section 9-1080.3(a)(2), a Zone
Reclassification that changes the permitted uses of a parcel from an agricultural to a nonagricultural use
shall require agricultural mitigation.
Pursuant to Development Title Section 9-1080.3(c), agricultural mitigation shall be satisfied by granting a
farmland conservation easement or other farmland conservation mechanism set forth in San Joaquin County
Development Title Section 9-1080.3(d) to or for the benefit of a Qualifying Entity. Pursuant to Development
Title Section 9-1080.3(f), final approval of any project subject to agricultural mitigation is contingent upon
the execution of the legal instrument to provide agricultural mitigation land and payment of the
administrative fee, or approval and payment of an in-lieu fee. Issuance of a building or grading permit for
the parcel will require submission of the required legal instrument. Pursuant to Development Title Section
9-1080.3(f), submission of the required legal instrument or payment of the in-lieu fee shall occur at the
time of grading permit or building permit issuance for future development.
San Joaquin County PA-1800162 & PA-1800163\Holly Commerce Center
Community Development Page 6
