STORMWATER <br /> General Plan 2035 Policy Document Stormwater Drainage, Policy IS-7.2(Page 3.2-41) <br /> The County shall require the minimum standards for stormwater drainage system <br /> improvements provided in Table IS-3 for the approval of tentative maps and zone <br /> reclassifications. <br /> General Plan 2035 Policy Document Table IS-3 (Page 3.2-41) <br /> New development in urban communities shall have access to a public drainage system, with <br /> terminal drainage. <br /> • The project parcel has historically drained runoff into Sugar Cut. Future development <br /> on the parcel will be permitted to utilize a detention system that stores water and then <br /> discharges at a pre-development rate into adjacent Sugar Cut. <br /> -Bases-for Zone Reclassification <br /> Development Title Section 9-812.4 states that -prior to approving an application for a Zone <br /> Reclassification, the Planning Commission and Board of Supervisors shall determine that all of <br /> the following are true: <br /> a) The proposed zone is consistent with the General Plan, any applicable Master Plans, and <br /> any applicable Specific Plan; <br /> • The Warehouse (I-W) zone is an implementing zone of the Limited Industrial (I/L) <br /> General Plan land use designation. If the General Plan designation is changed to <br /> I/L, then the zone change to I-W would be consistent with the General Plan. There <br /> are no applicable Master Plans or Specific Plans in the vicinity. <br /> b) The proposed zone district is reasonable and beneficial at the time. <br /> • The proposed Zone Reclassification for the 54.9 acre portion of the parcel is <br /> reasonable and beneficial at this time as the site is not productive farmland and is <br /> adjacent to existing industrial operations. The remaining 67.65 acres of the subject <br /> parcel is currently zoned for and developed with industrial uses. The zone <br /> reclassification will bring consistency to the parcel zoning. The adjacent properties <br /> to the north are currently zoned AG-40, and the adjacent properties to the east, <br /> west, and south are in the City of Tracy. <br /> Agricultural Mitigation <br /> This project includes a Zone Reclassification application that proposes to change the permitted land <br /> use from an agricultural to a nonagricultural land use. Pursuant to Development Title Section 9- <br /> 1080.3(a)(2), a Zone Reclassification that changes the permitted uses of a parcel from an <br /> agricultural to a nonagricultural use shall require agricultural mitigation. <br /> Pursuant to Development Title Section 9-1080.3(c), agricultural mitigation shall" be satisfied by <br /> granting a farmland conservation easement or other farmland conservation mechanism set forth in <br /> San Joaquin County Development Title Section 9-1080.3(d) to or for the benefit of a Qualifying <br /> Entity. Pursuant to Development Title Section 9-1080.3(f), final approval of any project subject to <br /> agricultural mitigation is contingent upon the execution of the legal instrument to provide <br /> agricultural mitigation land and payment of the administrative fee, or approval and payment of an <br /> in-lieu fee. Issuance of a building or grading permit for the parcel will require submission of the <br /> required legal instrument. <br /> 3 <br />
