Item No. 4 <br /> PC: 6-17-93 <br /> UP-93-7 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. UP-93-7 with the Findings and Conditions of Approval given in the <br /> staff report. <br /> FINDINGS <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan <br /> and any applicable Speck Plan or Special Purpose Plan. <br /> • This finding can be made because the proposed golf course and driving range may <br /> be conditionally permitted in the AG-40 zone, which Is an Implementing zone of the <br /> General Plan designation of General Agricutture. The project meets the General Plan <br /> policy for golf courses in an agricultural area, since it will serve the Tracy area. <br /> 2. Adequate utilities,roadway improvements,sanitation,watersupply,drainage,and other necessary <br /> facilities have been provided,and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the site has access by frontage on MacArthur <br /> Drive. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the site plan, along with the recommended <br /> conditions of approval,will ensure that all code requirements and other standards will <br /> be met. The finished floor elevation of structures will have to be at 21 feet NGVD to <br /> comply with the standards of construction within the flood hazard. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because a habitat management plan to mitigate potential <br /> Impacts to the Swainson's hawk is required and will be administered by the <br /> Department of Fish and Game. <br />
