CONDITIONS OF APPROVAL FOR UP-93-3 <br /> Unless otherwise specified, all CondWons of Approval must be fulfilled prior to the establishment of <br /> the use and the Issuance of any building permits. <br /> This approval will expire 18 months from the date of approval unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary building permits have been secured and remain in force, <br /> and (3) all necessary permits from other agencles have been secured and remain In force. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. DEVELOPMENT SERVICES DIVISION: <br /> a This project may be developed in phases. Prior to implementing Phase 11,the owner shall <br /> request in writing that Minor Subdivision No. MS-92-103 be declared null and void. Phase <br /> I shall be completed within 18 months of the date of approval. Phase II shall be <br /> completed within three years of the date of approval. <br /> b. If the Parcel Map for approved Minor Subdivision No. MS-92-103 is recorded, screening <br /> of the parking lot shall be provided as required by Section 9-1020.8 of the Development <br /> Title. Also, a 30-foot-high net is required along the south property line of the homesite <br /> parcel west of the tees. <br /> C. One parking space is required for each tee. <br /> d. The parking area shall be landscaped pursuard to Section 9-1020.6 of the Development <br /> Title. <br /> e. Trash bins shall be kept in an enck)sure with solid masonry walls on three sides and <br /> gated on the fourth side. <br /> f. All structures shall meet the Flood Hazard Reduction requirements of the Development <br /> Title. <br /> g. Nighttime operations are not permitted unless an improvement plan showing lighting is <br /> provided. Any future lighting shall meet commercial lighting requirements of the <br /> Development Title. <br /> h. Submit an Improvement Plan, prepared by a Registered Civil Engineer,showing drainage, <br /> driveway access details, on-site parking, existing and proposed utility services, and <br /> grading. A plan check fee will be required (Development Title Section 9-884) <br /> i. The applicant shall comply with the attached mitigation monitoring program. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a The frontage improvements for MacArthur Drive shall be constructed in conformance with <br /> standards for one-half of a 60-foot-wide rightof-way rural collector road. The construction <br /> of the frontage improvements will be deterred upon execution by the owner of a Deferred <br /> Conditions of Approval - 1 - UP-933 <br />
