PA-1200019 OF DOMINIQUE <br /> AND BERNADETTE ARRABIT (APN: 248-170-01, ADDRESS: 27506 S. <br /> MACARTHUR DRIVE, TRACY) <br /> This project is a Site Approval application for a landscaping services business and a <br /> request to modify the screening requirements of Development Title Section 9-1022.4(d) <br /> to permit for a wooden fence instead of the required masonry wall screening. (Use <br /> Type: Nursery Sales and Service- Landscaping Services) The project consists of <br /> converting 200 square feet of an existing 510 square foot garage as an office and <br /> utilizing an existing 2,400 square foot storage building for storage of landscaping <br /> equipment. The business will operate Monday through Friday from 7:00 a.m. to 3:30 <br /> p.m. and will consist of three employees. <br /> There is an existing residence at the site that is not a part of the project. <br /> The General Plan designation is Rural Residential (R/R) and the zoning is Rural <br /> Residential (R-R). <br /> This project is located at the southeast corner of Etcheverry Drive and MacArthur Road, <br /> southeast of Tracy. <br /> The Community Development Department has reviewed the application and offers the <br /> following comments regarding screening and landscaping: <br /> Background <br /> On April 12, 1972, the Zoning Administrator approved Use Permit application No. <br /> UP-72-310 to permit a walnut hulling business at the project site. On December 2, 2011, <br /> the Community Development Department opened an enforcement case (EN-1100607) <br /> at the project site for the operation of a landscaping business without benefit of proper <br /> permits. Development Title Section 9-305.2 states the Nursery Sales and Service- <br /> Landscaping Services use type would not be a permitted use in the Rural Residential <br /> zone. However, Development Title Section 9-235.3 states a nonconforming use <br /> conducted at least partially within a structure may be changed to another nonconforming <br />
