The cost of such <br /> consultation shall be included in the inspection fee Upon completion of the review, the <br /> Zoning Administrator shall prepare a written report for the Board of Zoning Adjustment <br /> and the operator. Additional inspections may be conducted, but the cost of additional <br /> inspections shall be paid for by the applicant only if noncompliance with the conditions of <br /> excavation permit is found. If the inspections reveal noncompliance with the approved <br /> excavation permit, the Board of Zoning Adjustment will conduct a revocation hearing. If <br /> the permit is revoked, any trust fund, performance bond, or other security provided for the <br /> project may be used to rehabilitate the property. <br /> p. A specific condition on performance guarantee is required to ensure rehabilitation of the <br /> site and compliance with conditions of approval. The amount of the guarantee will be <br /> based on the estimated cost of rehabilitation for each phase and will be fully in force for <br /> any phase which is being excavated or has been excavated but is not fully rehabilitated. <br /> The estimated cost of rehabilitating each phase as provided by the applicant shall be <br /> reviewed by the Department of Public Works at the time of the application and every five <br /> (5) years after the approval of a permit. No financial guarantee will be required for areas <br /> not excavated. The guarantee will be required for areas not excavated. The review <br /> authority may modify the amount of the guarantee required based upon these reviews. <br /> When an inspection shows that a phase has been rehabilitated in conformance with the <br /> approved permit, the Zoning Administrator will terminate the financial guarantee for that <br /> phase. On abandonment of the excavation for eighteen (18) months or more, bankruptcy <br /> of the operator of any occurrence which, in the opinion of the review authority, <br /> jeopardizes the rehabilitation of the excavation, the County may use all or any portion of <br /> the fund to rehabilitate the site. The type of financial guarantee proposed by the applicant <br /> under this Section must be found acceptable by the County Counsel prior to the public <br /> hearing on the permit. The type of financial guarantee may be, but is not limited to: <br /> i. A faithful performance bond. <br /> ii. A property escrow or escrow account. <br /> iii. A trust fund. <br /> q. Excavation shall be set back a minimum of 50 feet from the planned rights-of-way widths <br /> of MacArthur Drive, Linne Road, and Tracy Boulevard. Excavation shall also be setback <br /> a minimum of 50 feet from the Banta Carbona Irrigation District Canal, Corral Hollow <br /> Creek, and the Western Pacific Railroad tacks. <br /> r.
