Development of the 62 acres site as proposed will result in the <br /> loss of approximately half of the site as forage for the hawk, and <br /> potentially more in the future if the ponds are expanded. In order <br /> to mitigate for the loss of Swainson' s hawk foraging grounds, it is <br /> likely that off site replacement habitat will be required, to the <br /> specifications of the Department of Fish and Game. There is also <br /> the possibility that a State endangered plant exists on site; the <br /> Delta Button Celery, which is indicated on the Natural Diversity <br /> Data Base. <br /> Air Ouality <br /> 4 .a. <br /> No information relative to potential odor problems has been <br /> submitted; the application does note that odors are not expected <br /> because the ponds will be used to percolate treated wastewater. <br /> The applicant ' s engineer has also stated that the ponds will accept <br /> tertiary-treated effluent containing no nitrogen, low B.O. D. , and <br /> that has been chlorinated. Environmental Health has stated that <br /> the ponds may give off an offensive or obnoxious odor during <br /> certain climatic conditions, nevertheless. <br /> Natural Resources <br /> 6.b. , 13 .b. <br /> Pursuant to the California Surface Mining and Reclamation Act of <br /> 1975 (SMARA) , the State Mines and Geology Board has designated the <br /> sand and gravel deposits that are of regional and statewide <br /> significance. The proposed project site is within an area <br /> designated as a Mineral Resource Zone (MRZ-2) , containing <br /> significant deposits of sand and gravel. The Extractive Resources <br /> portion of the Resources section in the County' s General Plan <br /> contains the following objective and policy pertinent to this <br /> proposal: <br /> objectives: 1 . To protect extractive resources from urban <br /> development or encroachment. <br /> Policies: 1. Mineral deposits of significant quantity, <br /> value, or quality, as identified by the State <br /> Division of Mines and Geology reports as MRZ-2 <br /> Mineral Resource Zones (see Figure VI-4) , shall <br /> remain in open space uses until extraction of <br /> resources, unless the immediate area has been <br /> committed to other uses. <br /> This project will not involve any resource extraction. Although <br /> the proposed ponds are planned to be permanent, no structures are <br /> proposed and it is conceivable that someday the ponds could be <br /> relocated and the resources on site could be mined. Thus, this is <br /> considered to be a less than significant impact. <br />
