Analysis <br /> Background <br /> The General Plan designation is Limited Agriculture(A/L), and the zone classification is Limited Agriculture <br /> with a ten acre minimum for a new parcel(AL-10). The subject parcel is currently being used for agriculture <br /> and contains one residence. The subject parcel is a portion of the Magnolia Farm subdivision recorded in <br /> 1914 and contains Lots 30 to 32 of this antiquated subdivision. In 1972 a subdivision was approved to <br /> divide Lot 32 into three parcels. However, this subdivision was never recorded. The history page also <br /> indicates that Farm Labor Mobile Home permits were granted in 1974 and 1988. These structures are no <br /> longer present on the property. <br /> Development Title Requirements <br /> Proposed Parcels 1 through 6 meet all Development Title requirements pertaining to minimum lot size and <br /> road frontage. Proposed Parcel 7 is 9.76 acres in size and therefore requires a Deviation to create a parcel <br /> under the 10-acre minimum zone requirement. <br /> Deviation applications are ordinarily processed at staff level with notification to surrounding property owners. <br /> This Deviation application is being referred to the Planning Commission because it is being processed with <br /> a Major Subdivision application. <br /> Under Section 9-824.2(b)of the Development Title, an applicant may request approval of a Deviation <br /> application to alter area requirements up to ten percent of the required lot area. The applicant is requesting <br /> approval of a 9.76-acre parcel in a ten-acre minimum zone(AL-10),which is under ten percent of the <br /> required lot area. <br /> The Deviation is being requested because the realignment of Campbell Road in 1939 reduced the size of <br /> the subject property. The realignment constitutes a special circumstance that does not apply to other <br /> property in the area and would cause a denial of privileges if the area regulations were strictly applied in this <br /> case. In order to approve a Deviation request,the review authority must make the findings required in <br /> Section 9-824.5 of the Development Title. Findings for approval of the Deviation are found on page 5 of this <br /> staff report. <br /> Irrigation Requirements <br /> The Tentative Map shows the location of the irrigation line serving the existing parcel.
