lft� III. COUNTY COUNSEL <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code,the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br /> and employees from any claim, action, or proceeding against the local agency or its agents, <br /> officers,or employees to attack, set aside, void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body concerning a subdivision,which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> IV. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Alex Chetley, 209- <br /> 468-3000) <br /> 1. The Traffic Impact Mitigation Fee will be required when parcels are developed. The fee is due <br /> and payable at the time of building permit application. <br /> NOTES: <br /> (i.) Any construction activity that results in the disturbance of at least one (1)acre of soil shall <br /> require a State NPDES construction permit. Dischargers whole projects disturb 1 or <br /> more acres of soil or whole projects disturb less than one (1)acre of soil and is not part of <br /> a larger plan of development, are required to obtain coverage under the current General <br /> Permit for Discharges of Storm Water Associated with Construction Activity <br /> (www.swrcb.ca.gov/stormwtr/gen_const.html#const_permit). Construction activity <br /> subject to this permit includes clearing, grading and disturbances to the ground such as <br /> stockpiling, or excavation, but does not include regular maintenance activities performed <br /> to restore the original line, grade, or capacity of the facility. <br /> r.. (ii.) All future building permits for projects located within a Special Flood Hazard Area at the <br /> time of permit issuance shall meet the San Joaquin County flood hazard reduction <br /> requirements(Title 9, Chapter 9-1605)and all requirements of the State of California <br /> (CCR Title 23)that are in force at the time of permit issuance. As an example, these <br /> requirements may include raiding the finish floor elevation one foot above the expected <br /> flood level and/or using flood resistant materials. <br /> V. ENVIRONMENTAL HEALTH DEPARTMENT (Staff Contact: Ted <br /> Tasiopoulos, 209-953-7698) <br /> 1. A qualified environmental professional shall prepare a surface and subsurface contamination <br /> report, identifying any potential source of surface or subsurface contamination caused by <br /> past or current land uses. The report shall include evaluation of non-point source of <br /> hazardous materials, including agricultural chemical residues, as well as potential point <br /> sources, such as fuel storage tanks, septic systems, or chemical storage areas. The report <br /> shall be submitted to the Environmental Health Department at time of submittal of a tentative <br /> map (San Joaquin County Development Title, Section 9-905.12). <br /> A review fee of$250 shall be paid at the time of submittal to the Environmental Health <br /> Department. <br /> NOTE: The Environmental Health Department received a report dated November 30, 2004. <br /> Prior to recordation of Final Map, an addendum shall be submitted to the Environmental <br /> Health Department and approved by the Environmental Health Department. <br /> 2. Connection to a public sewer system is required (San Joaquin County Development Title, <br /> Section 9-1105.2[bj). <br /> 21 <br />
