il. MOUNTAIN HOUSE COMMUNITY SERVICES (Staff Contact: Morgan Groover, <br /> 209-831-5666) <br /> GENERAL <br /> 1. All subdivision improvements shall be in conformance with Community Approvals, including, but not <br /> limited to, subdivision improvement plans and specifications, the latest Improvement Standards and <br /> Specifications of the Mountain House Community Services District(MHCSD), the Design Manual, <br /> Master Plan, Specific Plan Il, master utility plans, and other standards and plans adopted by the <br /> MHCSD. These improvement plans and specifications must be approved by the MHCSD prior to <br /> approval of each phased Final Map or before any work is commenced. <br /> 2. The developer shall comply with all requirements of EIR, SP ll, and SP II Initial Study, including, but <br /> not limited to, County, State and Federal requirements relative to air quality, storm water discharge, <br /> waste disposal and hazardous waste. Any reference to Standards used in these Conditions of <br /> Approval shall be interpreted to be the MHCSD Standards in effect at the time of the improvement <br /> plan final submittal and approval to the extent that such standards do not conflict with the MARA. <br /> 3. MHCSD Master Restrictions shall be recorded on the property concurrently with the recordation of <br /> any final map. <br /> 4. Prior to submitting any Final Map the applicant shall prepare a Town Center Community Facilities <br /> Plan. The Plan shall determine the location, size, character and use of all Community Facilities to <br /> be constructed in the Town Center and demonstrate that the Facilities are in compliance with <br /> Community Approvals. The Plan shall be approved by MHCSD prior to the submittal of any Final <br /> Map for the Town Center. The Town Center Community Facilities Plan shall include the Mountain <br /> House Creek conceptual design from Central Parkway Bridge to Byron Road Bridge. The <br /> architecture of buildings and open spaces shall comply with the town center guidelines. Maintain <br /> multiple story mixed use concept. <br /> 5. All required onsite and offsite easements and dedications shall be offered to the MHCSD through <br /> offers of dedication to the MHCSD or shall be recorded on the Final Map. Dedication of public <br /> rights-of-way shall be in conformance with the adopted Public Land Equity Program (PLEP). A 6 <br /> feet minimum PILE shall be dedicated on all property adjacent to any public roadway or adjacent to <br /> any joint trench or other public utilities or as otherwise approved by MHCSD. Any easements to be <br /> abandoned that belong to an irrigation district shall not be abandoned without prior approval of that <br /> district. <br /> 6. All costs incurred by the MHCSD for any applicant development project shall be paid by the <br /> applicant in accordance with the MHCSD Development Project Fees for Services Agreement, dated <br /> October 9, 2009, between MHCSD and Shea Mountain House LLC. or a later development <br /> agreement between MHCSD and the developer. <br /> 7. Except where provided otherwise in a Project Acquisition Agreement or Project Reimbursement <br /> Agreement, prior to the recording of any Final Map, all infrastructure facilities outside the boundary <br /> of the Tentative Map (water, sewer, storm drainage, electric power, natural gas, telephone, <br /> communications, etc.)necessary to serve the Town Center shall be in place and fully operational. <br /> Any deferral of any improvements shall be approved by MHCSD and will require the developer to <br /> provide the MHCSD a bond or other forms of security approved by MHCSD, insuring the eventual <br /> construction of the facility. <br /> 8. All conditions on the"Will Serve Letter"from the MHCSD shall be met prior to approval of Final Map, <br /> unless specified otherwise in the letter. The MHCSD General Manager may defer the installation of a <br /> facility if bonding is provided and it can be demonstrated to the satisfaction of the MHCSD Public <br /> Works Director that it is not needed at that time. <br /> 10 <br />
