64. All buildings shall be wired per specifications in the"Low Voltage Construction Pre-wire Guidelines" <br /> and other specifications provided by the MHCSD, and in accordance with the latest version of the <br /> MHCSD Technology Master Plan. <br /> 65. To control erosion and sedimentation during project construction and operation, the developer shall <br /> comply with MHSWMP policies, MHSWMP mitigation measures, and Phase II NPDES permit <br /> requirements, including the preparation and implementation of a SWPPP that outlines BMPs to be <br /> followed to minimize erosion and sedimentation during project construction and operation. The <br /> Developer shall have qualified NPDES personnel on site. The developer shall pay all cost <br /> associated with the implementation and inspection of these requirements. <br /> 66. The developer shall build the required drainage system and water quality basins as required by <br /> MHCSD to accommodate runoff from the project. <br /> 67. Water Quality Basins Mosquito Abatement: Plans for the implementation and maintenance of the <br /> water quality basins and any other storm drainage facilities involving open bodies of water shall be <br /> reviewed and approved by the MHCSD and if required by the Mosquito Abatement District. <br /> 66. All non-residential (i.e. Office, Industrial, Commercial, etc), uses must enter into a commercial <br /> sanitary sewer and storm water discharge agreement with MHCSD. <br /> 69. UTILITIES <br /> A. The Developers and contractors shall comply with Ordinance No. 4162, MH-10-3000"Street <br /> Opening and Pavement Restoration Regulations". <br /> B. When any portion of an arterial street is to be included in a development's construction plans, <br /> then all of the buried utilities that are ultimately planned to be within the improvement area shall <br /> be installed as part of the street improvement project, regardless of any of the utilities needed for <br /> any phase of the development associated with the street construction. Conduits or sleeves may <br /> be installed in lieu of the buried utility, if approved by the MHCSD Public Works Director. <br /> C. Any phased development shall install all"in-tract" utilities needed to serve its development. In <br /> addition, if any future adjacent or nearby phases of the development, or adjacent Neighborhoods, <br /> will depend on obtaining service from such utilities, then the utility lines shall be sized to serve <br /> these future developments. Any utility lines that are intended to be used by an adjacent <br /> development or Neighborhood shall be installed up to the phase or Tentative Map boundary line <br /> to make it available for future extension.To recoup all or a portion of any over sizing costs, the <br /> developer may request the MHCSD to process a reimbursement agreement pursuant to the <br /> MARA. A Water Volume and Pressure Analysis shall be approved by the MHCSD for any <br /> phasing of the water system that is not served by completed portions of the Water Master Plan. If <br /> sufficient parameters are not met, then additional portions of the Water Master Plan may have to <br /> be completed, as determined by the MHCSD Public Works Director. <br /> D. When public utilities are to be located outside public rights-of-way but within the Tentative Map <br /> boundary, the developer shall provide public utility easements for these utilities. The easements <br /> shall be shown on all Final Maps and parcel maps. Prior to the submittal of improvement plans for <br /> the development,the developer shall submit to the MHCSD composite to-scale schematic plans <br /> for in-tract and outside the tract all storm drains, sanitary sewers, and water distribution facilities, <br /> both in plan and profile Any discovered conflicts shall be corrected prior to plan approval. <br /> E. Electrical transformers within residential Neighborhoods shall be in underground vaults, subject to <br /> MHCSD and Modesto Irrigation District(MID)requirements. The developer shall pay for any <br /> incremental costs relating to undergrounding transformers not paid for by MID. <br /> 16 <br />
