PLANNING COMMISSION MINUTES
MARCH 7 , 1991
1. ZONE RECLASSIFICATION APPLICATION NO. ZR-91-9 OF E. J. VASTI
AND R. C. HERNANDEZ to rezone 28 acres from R1-8 (Residential;
8, 000---square-foot minimum parcel size) to R1-U (Residential ; 6, 000-
square-foot minimum parcel size) . The property is located in an
area bounded by Carroll Avenue, Horner Avenue, Del Mar Avenue, and
Main Street, east Stockton (Supervisorial District 3) .
Associate Planner Steve St. Sure introduced a staff report into the
record.
PUBLIC HEARING OPENED
PROPONENTS: R. C. Hernandez was present for this application and
said he concurred with the staff report.
OPPONENTS: Russell Gray, 930 Coolidge, said he lives one block
away from the subject property and his backyard is Carroll Avenue.
He objected to the R1-U zone because he felt it would allow
incompatible uses and would legalize existing incompatible uses.
He said there are many small lots in the neighborhood and this
zoning would encourage further divisions in the area.
REBUTTAL: Mr. Hernandez said the proposal meets ordinance require-
ments and will conform to the future General Plan designation for
the area.
PUBLIC HEARING CLOSED
Comm. Carter asked how many parcels in that area have double
frontage and can be developed. Mr. St. Sure said there are 6
parcels that can be developed in the R1-U zone but not in the R1-8
zone.
Comm. Gillispie said that the applicant can create 3 parcels with
the existing R1-8 zoning and will get one more parcel with the R1-U
zone.
Chief Deputy Director Tom Walker said that sewer capacity is
available for the proposed parcels.
Comm. Carter pointed out that the area has mixed uses; that most of
the parcels are very deep and have frontage on two streets. There-
fore, splitting the property will give better use of the property;
sewers are available to the area; and now the neighborhood can be
improved.
MOTION: Moved, seconded (Carter-Rojas) and carried by a vote of
7-0 to:
1. Approve the Negative Declaration; and
-1-
