CONDITIONS OF APPROVAL <br /> GX-94-3 <br /> DeSoto <br /> Unless otherwise specified, all Conditions of Approval and Ordinance Requirements shall be <br /> complied with prior to commencement of grading and/or excavating. <br /> The approval will expire 18 months from the date of approval unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary permits have been secured and remain in force, and (3) <br /> all necessary permits from other agencies have been secured and remain in force. <br /> Those conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. The average finished grade elevation shall be no lower than 30.9 feet. (Development Title <br /> Section 9-1410.3[b][41) <br /> b. All Conditions of Approval shall be complied with and grading shall have commenced <br /> within 18 months of the date of approval of GX-94-3. Excavation and final rehabilitation <br /> of the site shall be completed within 18 months of the start of excavation. (Development <br /> Title Section 9-215.14) <br /> C. All private roads involved in the excavation shall be maintained so as to control the <br /> creation of dust. Dust control measures and haul roads shall be included on the <br /> Improvement Plan. (Planning Title Section 9-1410.3[a]) <br /> d. Provide certification of approval of proposed final grades from the Bret Harte Water Users <br /> District prior to authorization being given to commence the grading excavation. <br /> (Development Title Section 9-1410.3[b][21) <br /> e. Excavation operations shall not be carried on during the hours from 9:00 p.m. through <br /> 5:00 a.m., except during periods of declared national, state, or local emergency. <br /> (Development Title Section 9-1410.3[d]) <br /> f. All emissions shall be subject to the rules and regulations of the San Joaquin Valley <br /> Unified Air Pollution Control District. (Development Title Section 9-1410.3[f]) <br /> g. If noxious weeds are on the site, operations shall be in accordance with instructions from <br /> the Agricultural Commissioner of San Joaquin County. (Development Title Section 9- <br /> 1410.3[h]) <br /> h. Any night lighting established on the property shall be arranged and controlled so as not <br /> to illuminate public rights-of-way or adjacent properties.
