will likely conneot to public sewer, water, and terminal drainage from the City of Lathrop when it
is available. The"City of Lathrop has chosen not to annex this area at this time.
2. The summary discussion does not summarize any relevant findings, impacts and mitigations
included in and contained in the Kimley-Horn traffic impact analysis.A more detailed and accurate
traffic summary should be provided the IS.
z;.
'The Initial Study references the Kimley-Horn traffic impact analysis and was made available to
the City of Lathrop. The recommendations of the traffic study are contained in the conditions of
approval.
3. As documented in the traffic study, the existing LOS conditions and existing plus project LOS
conditions show that the Roth Road and the 1-5 ramps are impacted and yet, the project will only be
required to pay fair share of the cost of certain improvements and not correct or improve the
impacts. Withbut physical roadway improvements being performed at this time, the Roth Road and
1-5 4remain at unacceptable wi ramps ' table and impacted LOS conditions and thus the impacts are not
being g miti aged.
This project will,be phased over eight years. There is no approved schedule for the
i improvements fti Roth Road and 1-5.The applicant will pay $1,148,522.00 in mitigation fees. The
traffic study found that the size of the project does not warrant improvements at this time. When
the City of Lathrop,Caltrans,or the County improves the intersections, the funds will be
i available.
4. We have a goneral concern and disagreement with the recommended traffic impact mitigation to
use 4-way stop controlled intersections and believe that signalized intersections are warranted and
necessary to,properly address the LOS conditions.
The City of Lathrop did not submit any data to support their general concern and disagreement.
The traffic study:determined that stop-controlled intersections were adequate.
5. We have a general concern that the payment of traffic fees are not specified to go directly to the
local jurisdiction, in this case the City of Lathrop, as we are the agency that is directly responsible
I for the local road network improvements (i.e. Roth Road),
The Department of Public Works monitors the funding for individual intersections. The funds
will be allocateq to whichever jurisdiction improves the intersection(s).
3 6. The propos approach to mitigating traffic impacts does not appear to be consistent with State law
and mitigation practices. If the project is unable to fully mitigate the LOS Conditions by constructing
the necessary roadway improvements at this time, then the project would appear to trigger the need
for an Envirghmental Impact Report and make Findings of Overriding Consideration.
The traffic study.determined that stop-controlled intersections and fair-share payments are the
appropriate mitigations.
7. The summary.discussion does not mention or address the fact that this site is located in the City of
Lathrop Sph4I're of Influence (SOI). It is the City of Lathrop's desire and request to San Joaquin
County that 411 lands located within the City of Lathrop SOI be annexed into the City of Lathrop, be
developed under ourjurisdiction and be developed to the City of Lathrop standards and regulations.
We are concerned that a San Joaquin County approval of this and/or other development
applications l9cated in our SOI will make it more difficult in the long run for such properties to annex
into and be s;;rViced by-the.City of Lathrop.
San Joaquin County,:::" PA-08003021Kelly
Community Developrhent Page 6
;;r
