�r <br /> Travel Centel'(truck stop) being just across the fence line, I'm out of compliance, therefore I can't <br /> continue to grow the current crops on this land. Making me grow less profitable crops. Also with this <br /> Travel Centel being across the fence line, my buffer zones for using pesticides and herbicides will <br /> come into play. This will limit the products I can use and also restrict how close I can use chemicals <br /> to the Travei°.Center.Which basically puts me out of the farming business. <br /> The uses approved by this project will be contained to the subject parcel and the adjacent <br /> County roads.The parcel is zoned C-FS.A truck stop,auto fuel island, restaurants, and hotel are <br /> permitted in the-C-FS zone with an approved Use Permit application.There is a right-to-farm <br /> ordinance whereby the County of San Joaquin recognizes and supports the right to farm <br /> agricultural lands in a manner consistent with accepted customs, practices, and standards. <br /> The neighboring:parcel has frontage on a County maintained road and has a General Plan <br /> designation of Limited Industrial.The project parcel has a General Plan designation of <br /> Commercial Froeway Service. Both parcels are located adjacent to the Roth Road interchange <br /> of 1-5. <br /> 2. The wildlife tFat live on the property that is going to be homeless and looking to find a new home. <br /> Here's a share list, coyotes, hawks, burrowing owls, snakes, etc. Yes, all these animals live on this <br /> property, I've seen them all last week [end of December, 2009] roaming and flying, <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat <br /> Conservation aid Open Space Plan (SJMSCP). Participation in the plan satisfies requirements <br /> of both the state and federal endangered species acts, and ensures that the impacts are <br /> mitigated belovvra level of significance in compliance with the California Environmental Quality <br /> Act. The applicont has chosen to participate in the SJMSCP. The applicant will contact the <br /> Council of Governments staff regarding the scheduling of a SJMSCP biologist to perform a <br /> pre-construction survey and any other mitigation measures required by the Council of <br /> Governments. T.he pre-construction survey must be completed prior to any ground <br /> disturbance. <br /> 3 <br /> City of Lathrop <br /> The Community Development Department sent a referral to the City of Lathrop on March 28, 2008. The City <br /> responded in a mem" dated April 8, 2008. The memo stated that the City of Lathrop would not provide <br /> water or sewer to thisproject. It recommended an EIR, including a traffic study. The memo also <br /> recommended that Caltrans comment on the project(which they did in a memo dated January 10, 2010). <br /> The traffic study and-,the noise study were completed and the project was re-referred on December 11, <br /> 2009. The initial study was sent to the State Clearinghouse on December 22, 2009, <br /> The City of Lathrop sent a new memo dated December 22, 2009 that requested a copy of the initial study <br /> and an extra 15 daysfor review. After reviewing the initial study, the City of Lathrop sent a•third memo dated <br /> February 1, 2010. The memo contained seven comments that pertain to recommended changes to the <br /> initial study and express concerns regarding police and fire services, traffic issues, and land use issues. <br /> 1. Under Utilities and Public Services, Items 8.a. and 8.b. should be checked "yes" and the staff <br /> analysis revised to reflect that the project should be connected to-and utilize public utility services <br /> for sewer and:water provided by the City of Lathrop. <br /> Projects that are,contained on a single parcel do not require public services.A single parcel in <br /> the C-RS zone over two acres in size may be developed with a private septic system <br /> (Development Title Section 9-1105.3[b]),an individual well (Development Title Section 9- <br /> 1120.3[c], and on site storm drainage (Development Title Section 9-1135.3[bl).
