-3_ <br /> Response to Appeal-Statement No. 1 <br /> The concerns of Caltrans and the City were addressed in the traffic study. Caltrans was <br /> referred the application and reviewed the traffic impact study. Their comments include #s, <br /> the statement"adequate existing right-of-way at the ramp connections with Roth Road <br /> appears to be sufficient to accommodate future growth". They did not oppose the project, <br /> and they did not require the applicant to mitigate for a future interchange project because <br /> Caltrans does not have a project for this intersection at this time. <br /> The City of Lathrop argued that the project did not meet Caltrans standards and that it did <br /> not address the possible realignment of Manthey Road. But the City has now agreed to <br /> accept the traffic study. The applicant has agreed to pay an I-5/Roth Road Mitigation Fee <br /> of$576,500 to the City. Caltrans does not have any current plans for the improvement of <br /> the study intersections <br /> Appe 1 Statement No. 2 <br /> In his appeal statement, Mr. Dhoot states that, <br /> "Manthey Road should be realigned with this project and funds set aside for fair share of <br /> Traffic signalization at the intersections." <br /> Response to Appeal Statement No.2 <br /> It is not the applicant's responsibility to consider a road realignment project if that road <br /> project is not part of the City's General Plan or a Caltrans project. CEQA requires the <br /> project to mitigate significant impacts to a level deemed less than significant and the <br /> conditions of approval reflect mitigation measures that accomplish that goal. The <br /> Department of Public Works' conditions of approval require the applicant to pay a fair <br /> share contribution towards several mitigation measures at intersections along Roth Road <br /> totaling $1.15 million dollars, including lane and traffic signal timing modifications <br /> (Cumulative 2025 plus project scenario). <br /> Appeal Statement No. 3 <br /> In his appeal statement,Mr. Dhoot states, <br /> "Approval of stop signs [was granted] without fund for signahzation at all four <br /> intersections." <br /> I <br />
