4 <br /> -4- <br /> Response to Appeal Statement No. 3 <br /> The all way stop signs were determined by the traffic consultant to meet the CEQA <br /> requirement to mitigate the project's impacts to a less than significant level in the existing <br /> plus approved projects plus proposed project scenario(EPAP+PP)in accordance with <br /> County traffic study guidelines and County standards. <br /> Appeal Statement No. 4 <br /> In his appeal statement,Mr. Dhoot states that, <br /> "Approval of project [was granted] without realigning Manthey Road west of the KSC <br /> Travel Plaza." <br /> Response to Appeal_Statement No. 4 <br /> There is no nexus for the applicant to mitigate a road realignment project which is not a <br /> part of the City's General Plan, a Caltrans project, or a County specific road plan. <br /> Appeal Statement No. 5 <br /> In his appeal statement, Mr. Dhoot states that, <br /> "An EIR should be prepared." ; <br /> Response to Appeal Statement No. 5 <br /> All potentially significant environmental effects have been reduced to a level of less than <br /> significant with the inclusion of the recommended mitigation measures from the traffic <br /> study and the noise study. The Planning Commission approved a mitigated negative <br /> declaration and has determined that an EIR is not required. <br /> A legal ad for the public hearing was published in The Record on December 2, 2011. <br /> Public hearing notices were mailed on November 30, 2011. <br />
