e I Notification and CEQA The Initial Study was sent to the Clearinghouse and posted on December 22,2009,with a review period from December 22,2009,to January 20, 2010. The Initial Study has been available since that time, and Caltrans and the City of Lathrop have commented on the project. The tragic study is dated July 31,2009. The noise study is dated July 15,2009. The Initial Study,which includes mitigation from the traffic and noise studies, has been available for review by the public since December 22,2005. r The City of Lathrop has reviewed the Initial Study and the traffic study for this project.'Their comments are below.All potentially significant environmental effects have been reduced to a level of less than significant with the inclusion of the recommended mitigation measures from the traffic study and the noise study. Therefore,the Community Development Department has determined that a full BIR is not required. Public Utilities A single parcel in the C-FS zone over two acres in size may be developed with a private septic system (Development Title Section 9-1105.3[b]), an individual well(Development Title Section 9-1120.3[c],and on site storrn drainage(Development Title Section 9-1135.3[b]). The applicants would connect to the City of Lathrop for sewer,water, and terminal drainage if it were available.However,the City of Lathrop does not want to annex the area at this time or provide the services. Traffic R The applicant is r=esponsible for traffic Issues related to this project, including the Manthey Road and Roth Road intersection. Caltrans will provide any solution to the area wide traffic issues regarding freeway interchanges.Traffic mitigation for the project, as determined by the Department of Public Works, includes a 4-way"Stop"sign and a fair share payment of$610,038.00 for the intersection of Manthey Road and Roth Road. - The traffic study did not require the installation of a signal for northbound 1-5 traffic at Roth Road.A"Stop" sign is required and a fair share payment of$111,808.00 towards the construction of four intersections pursuant to the Public Works Department conditions of approval. Farming The uses approved by this project will be contained to the subject parcel and the adjacent County roads. f The parcel is zoned CFS.Atruck stop, auto fuel island,restaurants, and hotel may be conditionally permitted In the C-FS zone with an approved Use Permit application. The truck stop with truck parking will be the only use adjacent to any current agricultural use and A will be contained on the western portion of the parcel.The auto fuel island,restaurants, and hotel will be on the easter portion of the parcel,adjacent to Manthey Road.There is a rightto-farm ordinance whereby the County of San Joaquin recognizes and supports the right to farm agricultural lands in a manner consistent with accepted customs, practices, and standards. The neighboring parcel has frontage on a County maintained road and has a General Plan designation of Limited Industrial.The project parcel has a General Plan designation of Commercial Freeway Service.
