i <br /> Wildlife <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and <br /> Open Space Plan(SJMSCP). Participation in the plan satisfies requirements of both the state and federal <br /> endangered species acts, and ensures that the impacts are mitigated below a level of significance in <br /> compliance with the Califomia Environmental Quality Ad.The applicant has chosen to participate in the <br /> SJMSCP. The applicant will contact the Council of Governments staff regarding the scheduling of a <br /> SJMSCP biologist to perform a pre-construction survey and any other mitigation measures required by <br /> the Council of Governments.The pre-construction survey must be completed prior to any ground <br /> disturbance. <br /> City of Lathrop <br /> The Community Development Department sent a referral to the City of Lathrop on March 28,2008.The City <br /> responded in a memo dated April 8,2008.The memo stated that the City of Lathrop would not provide <br /> water or sewer to this project. It recommended an OR, including a traffic study.The memo also <br /> recommended that Caltrans comment on the project(which they did in a memo dated January 10, 2010). <br /> The traffic study and the noise study were completed and the project was re-referred on December 11, <br /> 2009.The initial study was sent to the State Clearinghouse on December 22,2009. <br /> The City of Lathrop sent a new memo dated December 22,2009 that requested a copy of the initial study <br /> and an extra 15 days for review.After reviewing the initial study,the City of Lathrop sent a third memo dated <br /> February 1, 2010.The memo contained seven comments that pertain to recommended changes to the <br /> Initial study and express the concems listed below regarding police and fire services,traffic issues, and land <br /> use issues. <br /> 1. Under Utilities and Public Services, Items 8.a. and 8.b.should be checked"yes"and the staff <br /> analysis revised to reflect that the project should be connected to and utilize public utility services <br /> for sewer and water provided by the City of Lathrop. <br /> Projects that are contained on a single parcel do not require public services.A single parcel in <br /> the C-FS zone over two acres in size may be developed with a private septic system <br /> (Development Title Section 9-1105.3[b]y,an individual well(Development Title Section 9- <br /> 1120.3[c],and on site storm drainage (Development Title Section 9-1135.3[b]). The applicants <br /> will likely connect to public sewer,water,and terminal drainage from the City of Lathrop when it <br /> is available. The City of Lathrop has chosen not to annex this area at this time. <br /> 2. The summary discussion does not summarize any relevant findings,impacts and mitigations <br /> included in and contained in the lQmley-Hom traffic impact analysis.A more detailed and accurate <br /> traffic summary should be provided the IS. <br /> The Initial Study references the Kimley-Flom traffic impact analysis and was made available to <br /> the City of Lathrop.The recommendations of the traffic study are contained in the conditions of <br /> approval. <br /> 3. As documented in the traffic study,the existing LOS conditions and existing plus project LOS <br /> conditions show that the Roth Road and the 1-5 ramps are Impacted and yet,the project will only be <br /> required to pay fair share of the cost of certain improvements and not correct or improve the <br /> impacts.Without physical roadway improvements being performed at this time,the Roth Road and <br /> I-5 ramps will remain at unacceptable and impacted LOS conditions and thus the impacts are not <br /> being mitigated. <br /> San Joaquin County PA-08001021Kelly <br /> Community Development page 5 <br />
