Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-0400646 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the proposed project is consistent with the conditional <br /> zoning as approved by Board of Supervisors Resolution R-02-667. The project is also <br /> consistent with the goals, policies, and standards, and maps of the General Plan. <br /> 2 Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the Public Works Department is requiring that water <br /> usage calculations be limited to 1,105 gallons per acre per day. The Environmental Health <br /> Department is requiring a soil suitability/nitrate loading study incorporating proposed staff <br /> and customer use, indicating that the area is suitable for septic tank usage. The parcel <br /> does not have access to a public storm drainage facility and will be required to retain any <br /> storm water run off on-site. As a result, the project will not significantly alter any drainage <br /> patterns or create additional storm water runoff onto adjacent roadways. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 34.74 acre parcel is of adequate size to <br /> accommodate the proposed project and all required on site improvements. Additionally, <br /> any structures resulting from this project shall be built according to the Uniform Building <br /> Code standards appropriate for this occupancy type. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts. <br /> San Joaquin County PA-0400646\MDP Valley Properties <br /> Community Development Page 4 <br />
