MS-93-120: <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three (3) years from the date of approval unless (1) all Conditions of <br /> Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the <br /> Surveyor's Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcels 1, 2, and 3 shall each contain 10 acres net (Development Title Section 9- <br /> 610.3{a){3)). Parcel sizes shall be shown on the Parcel Map. <br /> b. The minimum width of Parcels 1, 2, and 3 shall be 330 feet (Development Title Section <br /> 9-610.4). Parcel widths shall be shown on the Parcel Map. <br /> C. A Note shall be placed on the Parcel Map, and a Notice of Minor Subdivision Restriction <br /> shall be recorded concurrently with the Parcel Map, to the effect that the property shown <br /> on the Parcel Map is restricted from further subdivision, for homesite purposes, by <br /> Section 9-610.3 of the San Joaquin County Ordinance Code. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Development Title Section 9-915.2) <br /> b. The remainder shall be designated as 'Designated Remainder' on the Parcel Map. <br /> (Subdivision Map Act Section 66445) <br /> C. The Traffic Impact Mitigation Fee will be required when the parcels are developed. The <br /> fee is due and payable at the time of building permit application. The fee currently is <br /> $2,364.00 per single-family dwelling unit in the Escalon area. The fee shall be <br /> automatically adjusted July 1 of each year by the Engineering Construction Cost Index <br /> as published by the Engineering News Record. (Resolutions R-90-304 and R-91-1025) <br /> d. Dedication of a 25-foot-wide right-of-way from the centerline of McBride Avenue to the <br /> property line shall be required across the frontage of Parcels 2 and 3. Dedication of a <br /> 25-foot-wide right-of-way from the centerline of Lee Avenue to the property line shall be <br /> required across the frontage of Parcel 1. Dedication of a 50-foot-wide right-of-way for <br /> McBride Avenue (25 feet from the existing centerline) shall be required across across <br /> Parcel 1. (Development Title Section 9-860.4) <br />
