reclaim prime agricultural land to its former condition in compliance with the <br /> reclamation standards of Public Resources Code §2773. In addition, with regard <br /> to land under FSZ contract, it should be noted that a board or council shall not <br /> approve any use based on the compatible use provisions of Government Code <br /> 951238.1(c) (Government Code §51296.7). In conclusion with respect to this <br /> project, it appears that mining without reclamation to prime agricultural land <br /> cannot meet the requirements of Government Code §51238.2." <br /> The proposed project and reclamation plan do not propose to reclaim the project site to <br /> agricultural land and therefore cannot be approved. <br /> Options <br /> The applicant has the following options: <br /> • Revise the reclamation plan to propose reclaiming the site to the current level of <br /> agricultural production. <br /> Withdraw the application. <br /> If neither option is chosen by February 3, 2003, the Community Development <br /> Department will schedule the project for a Planning Commission hearing with a <br /> recommendation of denial based upon the inconsistencies with the Development Title <br /> and the Williamson Act compatible use provisions (Government Code§51238.1 and <br /> 51238.2). <br /> JJ:vb <br /> QX982 <br /> Attachments <br /> C: Greg & Laura Torlai <br /> G & G Farms <br /> Reeves Sand & Gravel <br />
