Analysis <br /> Project Description <br /> The Revisions of Approved Actions is being requested by the operator to allow more time to satisfy the <br /> Conditionsof Approval and also amend Public Works'requirement that the first 100 feet of the private access <br /> road be paved. The operator is having some difficulty in satisfying the reclamation bond requirements. The <br /> estimated cost of reclamation for the project is $157,000.00. It is recommended that Community <br /> Development Department Condition of Approval No. 1.b. be revised to allow the applicant six months to <br /> comply with the Conditions of Approval of the permitting agencies. Public Works concurs with the applicant's <br /> request to modify Condition No. 2.a.(1)to only require paving from the edge of pavement of McDonald Road <br /> to the right-of-way line. Community Development Department Condition No. 1.d. already provides that the <br /> balance of the first 100 feet be surfaced in a manner acceptable to the Director. <br /> This project is a Quarry Excavation Permit on the Greg Torlai and Greg Burgin property on ± 114 acres of the <br /> ± 314-acre site. This application superseded Grading Excavation Permit No. GX-96-6. The State <br /> Department of Conservation has advised staff that the farm exemption previously provided for under Public <br /> Resources Code Section 2714(d) for farming excavations is no longer applicable because the excavation <br /> from this property is in excess of 1,000 cubic yards and is for commercial purposes. This provision became <br /> effective on October 18, 1997, and is codified in California Code of Regulations(CCR)Section 3505(a)(3). It <br /> will take approximately five years to complete the excavation that was initiated in 1997. <br /> The excavation will take place in two phases. Phase 1 consists of 88.3 acres. The excavation process will <br /> salvage approximately 157,000 cubic yards of topsoil material from Fields 1, 3, and 4, as shown on the <br /> excavation/reclamationplan. Field 2 will not be excavated,but releveled. Field 4 has a large mound that will <br /> yield approximately 358,000 cubic yards of sandy material for export. Phase 2 consists of approximately <br /> 25.8 acres and will result in the removal of approximately 142, 000 cubic yards of sandy material for export <br /> and approximately 73,000 cubic yards of topsoil. The total material to be excavated for export from Phases 1 <br /> and 2 will be approximately 500,000 cubic yards,which would be excavated over a period of approximately <br /> five years. After the over-excavated areas are backfilled with topsoil, it is figured there will be approximately <br /> 40,000 cubic yards of excess topsoil to be spread and leveled. <br /> General Plan/Zoning <br /> The General Plan designation for the site is Agriculture(A/G). The proposal is consistent with the County's <br /> General Plan objectives and policies regarding extractive resources because the site contains significant <br /> mineral resources in the form of sand deposits. The zone is General Agriculture, 80-acre minimum parcel <br /> size(AG-80). <br /> Williamson Act <br /> Because the property is in the Williamson Act, the County must find that the "underlying contractual <br /> commitment to preserve prime land will not be significantly impaired." The proposal is consistent with the <br /> Williamson Act because at the conclusion of the excavation/reclamation process the entire 114.1 acres will <br /> be put back into agriculture and planted in such crops as corn, asparagus,and alfalfa. The project is phased <br /> to minimize the amount of agricultural land out of production at any one time.
