Analysis <br /> Project Description <br /> This application is for a Quarry Excavation Permit on the Greg Torlai and Greg Burgin property on ± 114 <br /> acres of the ± 314-acre site. This application,if approved,would supersede Grading Excavation Permit No. <br /> GX-96-6. The State Department of Conservation has advised staff that the farm exemption previously <br /> provided for under Public Resources Code Section 2714(d)for farming excavations is no longer applicable <br /> because the excavation from this property is in excess of 1,000 cubic yards and is for commercial purposes. <br /> This provision became effective on October 18, 1997,and is codified in California Code of Regulafions(CCR) <br /> Section 3505(a)(3). Therefore,in lieu of the applicantfiling for a Revisions of Approved Actions to grant more <br /> time, this project is being converted to a Quarry Excavation Permit. It will take approximately five years to <br /> complete the excavation that was initiated in 1997. <br /> The excavation will take place in two phases. Phase 1 consists of 88.3 acres. The excavation's releveling <br /> process would result in approximately 160,000 cubic yards of topsoil material, which would be excavated <br /> from Fields 1 and 3, as shown on the excavation/reclamation plan. This topsoil would then be placed on <br /> Field 4. Because of the excess topsoil available, the project proponent proposes to over-excavate <br /> approximately 4.3 feet in depth on Field 4, which would permit the removal of approximately 415,00 cubic <br /> yards of material for export. The average cut on Fields 1 and 3 is 2.1 and 2.4 feet respectively. The average <br /> cut on Field 4 would be 7 feet to the finished grade plus an additional 4.3 feet, for a total of 11.3 feet Staff <br /> has recommended that the final grades after reclamation be uniformly adjusted and raised one foot,which <br /> would be in conformity with the original approved permit for Grading Excavation Permit No. GX-96-6. Phase <br /> 2 consists of approximately 25.1 acres and will result in the removal of approximately 143, 500 cubic yards. <br /> The total material to be excavated for Phases 1 and 2 will be approximately 558,500 cubic yards, which <br /> would be excavated over a period of approximately five years. If staffs recommendation is approved to raise <br /> the elevations by one foot, this would result in the reduction of approximately 184,000 cubic yards of material <br /> to be removed from the site. <br /> General Plan/Zoning <br /> The General Plan designation for the site is Agriculture(AIG). The proposal is consistent with the County's <br /> General Plan objectives and policies regarding extractive resources because the site contains significant <br /> mineral resources in the form of sand deposits. The zone is General Agriculture, 80-acre minimum parcel <br /> size(AG-80). <br /> Williamson Act <br /> This property is in the Williamson Act. However, the proposal is consistent with the Williamson Act because <br /> at the conclusion of the excavation/reclamation process the property will be put back into agriculture and <br /> planted in such crops as corn, asparagus,and alfalfa. <br /> San Joaquin County QX-98-2\Torlai <br /> Community Development Page 5 <br />
