applicant is providing 7, 000 feet of amenities, plus 1000 feet of <br /> access and that there should be some recognition of that. He said <br /> that five homes are requiring a tremendous amount of conditions. <br /> He is requesting relief from two of the conditions: 1) park fee, <br /> and 2) left turn requirement from Caltrans. He said that the <br /> project is not on the road and the problem is with the State park <br /> which creates the need for the left turn. He said he has met with <br /> Cal Trans and the Department of Public Works but they could not <br /> reach an agreement. He said there should be some adjustment of the <br /> fee ($2, 000 per house) . They are willing to pay their fair share <br /> but not the entire cost of the left-turn lane. Mr. Hakeem said his <br /> clients are in agreement with the rest of the Conditions. In <br /> answer to a question, he said he has not had a discussion with the <br /> Lodi School District. He noted that the District had not responded <br /> to the project referral. <br /> Comm. Gillispie referred to the requirement of the 100 foot <br /> dedication along the Mokelumne River and asked if Mr. Hakeem read <br /> that requirement to mean that they are requiring continuous access <br /> to the Mokelumne. Mr. Hakeem said he thought it meant continuous <br /> access. The comment "easements along" is cumulative. <br /> Ernest Brown, P.O. Box 323 , Clements, said they worked with the <br /> County to give the 100 foot buffer but was concerned that the <br /> access would cause destruction to the habitat area. <br /> OPPONENTS: None. <br /> Al Johnson, 29855 Orange Ave. , Escalon, representing Cal Trans, <br /> said it was decided that a left turn pocket would be required at <br /> the intersection if the development added traffic. There is a <br /> problem with funding. <br /> REBUTTAL: Mr. Hakeem said the left turn improvements would require <br /> about $120, 000. <br /> PUBLIC HEARING CLOSED <br /> Comm. Carter said that this is a beautiful, environmentally <br /> sensitive area; however, the conditions of approval will provide <br /> some safeguards. She said she felt that the left-turn improvement <br /> will be needed and suggested that the applicant only be required to <br /> pay his "fair share. " <br /> Chairman Morri said the property will provide beautiful homesites. <br /> He said he is not sure he is in favor of the left-turn requirement. <br /> He said he would like to see a condition that there be no further <br /> subdivision made of the 40 acre parcels. <br /> Comm. Gillispie said that the left turn is not needed for only the <br /> five homes but rather for the people using the park and other <br /> activities. He suggested a joint venture between the County and <br /> MINUTES -10- FEB 21, 1991 <br />
