applicant is providing 7, 000 feet of amenities, plus 1000 feet of access and that there should be some recognition of that. He said that five homes are requiring a tremendous amount of conditions. He is requesting relief from two of the conditions: 1) park fee, and 2) left turn requirement from Caltrans. He said that the project is not on the road and the problem is with the State park which creates the need for the left turn. He said he has met with Cal Trans and the Department of Public Works but they could not reach an agreement. He said there should be some adjustment of the fee ($2, 000 per house) . They are willing to pay their fair share but not the entire cost of the left-turn lane. Mr. Hakeem said his clients are in agreement with the rest of the Conditions. In answer to a question, he said he has not had a discussion with the Lodi School District. He noted that the District had not responded to the project referral. Comm. Gillispie referred to the requirement of the 100 foot dedication along the Mokelumne River and asked if Mr. Hakeem read that requirement to mean that they are requiring continuous access to the Mokelumne. Mr. Hakeem said he thought it meant continuous access. The comment "easements along" is cumulative. Ernest Brown, P.O. Box 323 , Clements, said they worked with the County to give the 100 foot buffer but was concerned that the access would cause destruction to the habitat area. OPPONENTS: None. Al Johnson, 29855 Orange Ave. , Escalon, representing Cal Trans, said it was decided that a left turn pocket would be required at the intersection if the development added traffic. There is a problem with funding. REBUTTAL: Mr. Hakeem said the left turn improvements would require about $120, 000. PUBLIC HEARING CLOSED Comm. Carter said that this is a beautiful, environmentally sensitive area; however, the conditions of approval will provide some safeguards. She said she felt that the left-turn improvement will be needed and suggested that the applicant only be required to pay his "fair share. " Chairman Morri said the property will provide beautiful homesites. He said he is not sure he is in favor of the left-turn requirement. He said he would like to see a condition that there be no further subdivision made of the 40 acre parcels. Comm. Gillispie said that the left turn is not needed for only the five homes but rather for the people using the park and other activities.
