* the developer for the funding of the left turn. He said he had a <br /> problem with the 100 foot dedication requirement. He said he felt <br /> that would ruin the riparian habitat. He questioned whether State <br /> law required dedication for the full length. He said he felt that <br /> the park land fees were "double jeopardy. " Also, he said that the <br /> Fish and Game and the Fish and Wildlife requirements are being <br /> called Ordinance requirements rather than Conditions. He said the <br /> tree replanting requirements should be consistent. <br /> With regard to the Fish and Game and the Fish and Wildlife require- <br /> ments, Chief Deputy Director Tom Walker said that these are the <br /> conditions that both agencies say are necessary in order to comply <br /> with State and Federal legislation. <br /> Chairman Morri said the requirements should be listed as <br /> "conditions" and not "ordinance" requirements. <br /> Fish and Wildlife requirement No. 6.j . was revised (see motion) . <br /> Condition No. 11 (Parks and Recreation Department) was deleted. <br /> Mr. Hakeem was asked about a condition restricting the further <br /> division of the land and he said he would be willing to "live with" <br /> the condition that there be no further subdivision, but he would <br /> like to have the same right as his neighbors. If the people across <br /> the river, or next door, are subdividing their land, he should be <br /> able to have the same right. <br /> Mr. Walker worded a condition that no homesites, under the homesite <br /> provision of the ordinance, will be created on any of the parcels <br /> established by this tentative map. Mr. Hakeem concurred with that. <br /> MOTION: Moved, seconded (Carter-Rojas) and carried by a vote of <br /> 7-0 to: <br /> 1. Approve the Negative Declaration and the Mitigation Monitoring <br /> Program (Attachment A, in Staff Report) , and <br /> 2 . Approve Minor Subdivision Application No. MS-90-79 based upon <br /> the Findings and subject to the Conditions of Approval <br /> contained in the Staff Report and as modified below: <br /> Modified Conditions: <br /> Add: i.d. No homesite parcels, under the provisions of <br /> Section 9-4010.2 , may be divided from any parcel <br /> created by this Minor Subdivision.
