A note shall be placed on the Final Parcel Map indicating that <br /> all future development on the project site shall be consistent <br /> with the approved Habitat Management Plan. <br /> 4 . To mitigate for the loss of native oak trees (valley oak, <br /> quercus lobata; interior live oak, quercus wislizenii; and <br /> blue oak, quercus douglasii) resulting form construction and <br /> other development on the site, replacement shall be at the <br /> rate of 5-to-1 (five oak planting sites for each native oak <br /> removed) . The Habitat Management Plan shall include the <br /> planting details, monitoring methodology, performance <br /> objectives, and remedial actions developed in the Biological <br /> Resources Survey that was prepared for this project. <br /> 5. All construction and development shall be prohibited within <br /> the site' s riparian habitat (as shown on Figure 3 of the <br /> Biological Resources Survey) and an area extending one hundred <br /> (100) feet from the edge of the habitat. The riparian habitat <br /> and its buffer shall be shown on the Habitat Management Plan. <br /> 6. All construction and development shall be prohibited within <br /> one hundred (100) feet of the site's open water habitat, fresh <br /> water marsh, and vernal pools (as identified in the Biological <br /> Resources Survey) . These habitats and their buffers shall be <br /> shown on the Habitat Management Plan. <br /> 7 . Water levels in the open water habitats shall be maintained <br /> on a year round basis by continued pumping from existing water <br /> pumps on the Mokelumne River. The Habitat Management Plan <br /> shall include a note regarding pond levels and shall indicate <br /> the person(s) and mechanisms responsible for maintaining the <br /> pond water levels. <br /> 8 . Habitat elements (including native vegetation and snags in <br /> open areas away from buildings) shall be preserved. The <br /> details of habitat element protection shall be included in the <br /> Habitat Management Plan. Habitat elements shall be kept away <br /> from structures and managed so as not to create fire hazards. <br /> 9. A minimum twenty-five (25) foot wide radius buffer, in which <br /> all development and construction is prohibited, shall be <br /> established around all Elderberry shrubs on the site. <br /> Elderberry shrubs and their buffers shall be shown on the <br /> Habitat Management Plan. <br />
