Approve the Negative Declaration; and <br /> 2. Approve Revisions of Approved Actions Application No. RA-92-3 for Minor Subdivision <br /> Application No. MS-90-79 based on the Findings and subject to the Revised Conditions of <br /> Approval recommended in the staff report. <br /> FINDINGS <br /> 1. The proposed map is consistent with applicable General and Specific Pians. <br /> • This Finding can be made because the Agriculture land use designation permits the <br /> proposed subdivision, and the proposed map is consistent with the agricultural <br /> policies of the General Plan. No Specific Plans are Involved with the proposal. <br /> 2. The design or improvement of the proposed division is consistent with applicable General and <br /> Specific Plans. <br /> This Finding can be made because the subdivision's design and Improvements meet <br /> the minimum standards contained in the General Plan and because the proposed <br /> density is within the range allowed by the Agriculture General Plan designation. <br /> 3. The site is physically suitable for the type of development. <br /> This Finding can be made because all development requirements in the County's <br /> Planning Title and all minimum County standards are met by the proposed <br /> subdivision. <br /> 4. The site is physically suitable for the propose density of development. <br /> This Finding can be made because the number of parcels proposed is consistent with <br /> the Agriculture density of the General Plan and because the parcels are consistent <br /> with the Planning Title's area and width requirements for the AG-40 zone. <br /> 5. The design of the subdivision or the proposed improvements are not likely to cause substantial <br /> environmental damage or substantially and avoidably injure fish or wildlife or their habitat. <br /> This Finding can be made because adequate protection has been provided to prevent <br /> adverse Impacts to Valley Elderberry longhorn beetles that may be living in the she's <br /> scattered Elderberry shrubs. The protections include buffers for all Elderberry <br /> shrubs, establishment of a property owners' association to maintain the buffers, and <br /> United States Fish and Wildlife Service approval prior to the disturbance of any of the <br /> shrubs. The site's vernal pools are afforded protection by similar buffers. In <br />
