The existing habitat along the river will be <br /> protected by the Conditions of Approval requiring a 100-foot-wide dedication for <br /> public access and the preservation of habitat within the areas of dedication. Annual <br /> reporting requirements have been established under State and Federal requirements <br /> to monitor compliance with the above-outlined protections. <br /> 6. The design of the subdivision or the type of improvements is not likely to cause serious public <br /> health problems. <br /> This Finding can be made because conditions attached to the approval address any <br /> potential public health problems. Specifically, wells and sewage disposal systems <br /> will be subject to the Public Health Service's permitting requirements. <br /> 7. The design of the subdivision or the type of improvements will not conflict with easements, <br /> acquired by the public at large, for access through or use of property within the proposed <br /> subdivision. <br /> This Finding can be made because the nonexclusive access easement required along <br /> the subdivision's private right-of-way will be adequate to provide access for Lots 3, <br /> 7, and the Designated Remainder to a publicly maintained road. This easement will <br /> not interfere with any public easements on the project site. <br /> 8. Any land or improvements to be dedicated to the County are consistent with the General Plan. <br /> This Finding can be made because the required dedications on McIntire Road and on <br /> the private right-of-way must be consistent with the County's minimum standards for <br /> the design of streets that have been adopted to Implement the General Plan's Land <br /> Use/Circulation Element. The private right-of-way will be Improved to the standards <br /> required by the Uniform Fire Code. The requirement for dedications along the <br /> Mokelumne River and from the end of McIntire Road to the river, which is intended <br /> to secure public access to the river, Is consistent with the General Plan's Recreation <br /> Element. <br /> PROJECT DESCRIPTION <br /> The applicant is requesting a revision of the adopted Conditions of Approval in order to eliminate the <br /> Department of Public Works' requirement for frontage improvements along the subdivision's private right- <br /> of-way, along with improvements across the frontage of the parcels on McIntire Road. The Condition of <br /> Approval (No. 2(b), attached) also states that the required frontage improvements will be deferred upon <br /> execution of a Deferred Frontage Improvement Agreement. <br /> The application for which the Revisions of Approved Actions application has been submitted, Minor <br /> Subdivision Application No. MS-90-79, was approved by the Planning Commission on February 21, 1991. <br /> The project entailed the subdivision of two parcels containing a total of 324 acres into seven 40-acre <br /> parcels and a 44-acre designated remainder. Access to Lots 1, 2, 4, S, and 6 will be from the frontage <br />
