Item No. 1 <br /> PC: 11-7-91 <br /> RA-923 (MS-90-79) <br /> Page 4 <br /> STAFF ANALYSIS <br /> TRAFFIC/CIRCULATION: <br /> The Department of Public Works' requirement for frontage improvements on the private right-of-way is <br /> consistent with actions taken on similar subdivisions and would allow for possible future use of the right- <br /> of-way as a public roadway. As part of the discretionary Condition of Approval, the Department of Public <br /> Works required the construction of the frontage improvements to be deferred. <br /> In its response to the referral of the Revisions of Approved Actions application, the Department of Public <br /> Works stated that the requirement for frontage improvements on the private right-of-way may be deleted <br /> from the adopted Conditions of Approval. Public Works feels that the right-of-way is not likely to be <br /> needed in the future for a public roadway because of the following facts: (1) the limited number of <br /> homes tes that will be served by the private right-of-way(see Condition of Approval No. 1(d)), (2)the right- <br /> of-way is not located on either a section or quarter-section line, and (3) the right-of-way cannot be <br /> provided with secondary access to a publicly maintained roadway. Condition of Approval No. 2(b) <br /> (attached) reflects the Department of Public Works' revision to the original Conditions of Approval. <br /> With the removal of the requirement for future public street improvements on the private right-of-way, its <br /> improvements will be to the standards of the Clements Rural County Fire District (see 'Conditions of <br /> Approval'). The actual improvements will be installed prior to the issuance of residential building permits, <br /> as stated in the 'Conditions of Approval for RA-923' on Page 5 of this staff report. <br /> The deletion of the requirement for frontage improvements along the private right-of-way does not affect <br /> the requirement for frontage improvements on McIntire Road. The Conditions of Approval continue to <br /> require the deferment of the actual improvements by the execution of a Deferred Frontage Improvement <br /> Agreement by the property owner. <br /> ENVIRONMENTAL CONSIDERATIONS: <br /> The Initial Study prepared for this project did not identify any significant, adverse environmental impacts. <br /> On the basis of that review, a Negative Declaration was prepared. The Initial Study that was prepared <br /> for the Minor Subdivision application (MS-90-79) on November 27, 1990, indicated that, although the <br /> subdivision had the potential to result in significant environmental impacts, the mitigation measures that <br /> were incorporated into the project would prevent the occurrence of such impacts. On the basis of that <br /> analysis, a Negative Declaration was prepared by staff and approved by the Planning Commission, along <br /> with a Mitigation Monitoring Program, on February 21, 1991. Staff's analysis of the Revisions of Approved <br /> Actions application indicated that no additional adverse environmental impacts beyond those identified <br /> by the Initial Study for the Minor Subdivision application would occur as a result of the approval of this <br /> application. <br />
