6. UNITED STATES FISH AND WILDLIFE SERVICE: Conditions of Approval: The conditions listed below have been identified as necessary to keep this project in compliance with the Endangered Species Act of 1973 . a. No recontouring or regrading shall occur within the one hundred (100) foot buffer around the vernal pools. No grading permits shall be issued for work within one-half mile of a vernal pool without prior approval from the Service. b. No roads or driveways shall be located within the buffers of the vernal pools. Roads and drives shall be designed and constructed to avoid adverse impacts to the hydrology of the vernal pools. C. Use of vernal pool buffers by off-road vehicles, cattle, and other livestock shall be prohibited. The Habitat Management Plan shall include a discussion of the methods proposed to implement this Condition. d. Septic systems and leach lines shall be designed and placed so that they do not adversely affect the water quality of the vernal pools. e. The use of herbicides, insecticides, and pesticides shall be prohibited within the vernal pool ' s buffers. f. The Annual Compliance Report shall be prepared by a qualified biologist and submitted to the Service for approval. g. In the event of habitat damage or destruction, the property owner shall be responsible for restoration of the site to pre-project conditions. The restoration shall be subject to approval by the Service and the California Department of Fish and Game. h. The above Conditions of Approval shall be included in the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that is submitted for approval to the California Department of Real Estate (CDRE) . A copy of the CC&R and the final homeowner' s Articles of Incorporation and association budget that is approved by the CDRE should be sent to the Service. i. A Habitat Management Plan, prepared by a qualified biologist, shall be submitted for approval to the Conditions of Approval - 5 - (MS-90-79)
