6. UNITED STATES FISH AND WILDLIFE SERVICE: <br /> Conditions of Approval: <br /> The conditions listed below have been identified as necessary <br /> to keep this project in compliance with the Endangered Species <br /> Act of 1973 . <br /> a. No recontouring or regrading shall occur within the one <br /> hundred (100) foot buffer around the vernal pools. No <br /> grading permits shall be issued for work within one-half <br /> mile of a vernal pool without prior approval from the <br /> Service. <br /> b. No roads or driveways shall be located within the buffers <br /> of the vernal pools. Roads and drives shall be designed <br /> and constructed to avoid adverse impacts to the hydrology <br /> of the vernal pools. <br /> C. Use of vernal pool buffers by off-road vehicles, cattle, <br /> and other livestock shall be prohibited. The Habitat <br /> Management Plan shall include a discussion of the methods <br /> proposed to implement this Condition. <br /> d. Septic systems and leach lines shall be designed and <br /> placed so that they do not adversely affect the water <br /> quality of the vernal pools. <br /> e. The use of herbicides, insecticides, and pesticides shall <br /> be prohibited within the vernal pool ' s buffers. <br /> f. The Annual Compliance Report shall be prepared by a <br /> qualified biologist and submitted to the Service for <br /> approval. <br /> g. In the event of habitat damage or destruction, the <br /> property owner shall be responsible for restoration of <br /> the site to pre-project conditions. The restoration <br /> shall be subject to approval by the Service and the <br /> California Department of Fish and Game. <br /> h. The above Conditions of Approval shall be included in the <br /> Declaration of Covenants, Conditions and Restrictions <br /> (CC&Rs) that is submitted for approval to the California <br /> Department of Real Estate (CDRE) . A copy of the CC&R and <br /> the final homeowner' s Articles of Incorporation and <br /> association budget that is approved by the CDRE should be <br /> sent to the Service. <br /> i. A Habitat Management Plan, prepared by a qualified <br /> biologist, shall be submitted for approval to the <br /> Conditions of Approval - 5 - (MS-90-79) <br />
