California Department of Fish and Game and the United <br /> States Fish and Wildlife Service prior to recordation of <br /> the Parcel Map. <br /> At a minimum, the Habitat Management Plan shall include <br /> all parcel lines, topographic details, the location of <br /> all identified habitats, the 100-year flood elevation, <br /> all water courses and pools, required buffers, and the <br /> total square footage of construction (yearly and <br /> cumulative) for each parcel and the Designated Remainder. <br /> j . The Habitat Management Plan shall include the planting <br /> details, the five-year monitoring methodology, <br /> performance objectives, and remedial actions developed in <br /> the Biological Resources Survey that was prepared for <br /> this project. <br /> k. A minimum 25-foot-wide radius buffer, in which all <br /> development and construction is prohibited, shall be <br /> established around all elderberry shrubs on the site. <br /> Elderberry shrubs and their buffers shall be shown on the <br /> Habitat Management Plan. <br /> 1. No grading (as defined by the Uniform Building Code, <br /> 1988 , Section 7003) shall be permitted within 0. 5 mile of <br /> a vernal pool unless the area to be graded is determined, <br /> by a qualified biologist, not to contain California tiger <br /> salamanders. Issuance of a grading permit for property <br /> within 0. 5 mile of a vernal pool shall be subject to <br /> California Department of Fish and Game and U. S. Fish and <br /> Wildlife Service approval of the biologist ' s report. If <br /> these agencies confirm that no California tiger <br /> salamanders exist within 0 . 5 mile of a vernal pool, <br /> grading may take place outside of the 100-foot buffer <br /> required by Condition of Approval No. 1 (f) . The details <br /> of limitations on grading shall be included in the <br /> Habitat Management Plan. <br /> M. The services of a qualified biologist shall be retained <br /> to prepare an annual report on the status of compliance <br /> with the requirements of the Habitat Management Plan. <br /> The report shall be submitted for approval to the DFG and <br /> USFWS prior to the yearly anniversary of the effective <br /> date of Minor Subdivision Application No. MS-90-79 . The <br /> owner shall establish a property owners ' association to <br /> be responsible for the preparation and submission of the <br /> annual compliance report.
