The private right-of-way serving the subdivision and the <br /> driveways to future residences and other structures shall <br /> not be located within any of the required buffers. A <br /> note to that effect shall be included in the Habitat <br /> Management Plan. <br /> 7 . CALIFORNIA DEPARTMENT OF FISH AND GAME: <br /> Conditions of Aooroyal : <br /> The conditions listed below have been identified as necessary <br /> to keep this project in compliance with the Endangered Species <br /> Act of 1973 . <br /> a. The Annual Compliance Report (see Planning Condition <br /> No. lk) shall be submitted to the Department for approval <br /> for a minimum of five years. <br /> b. All construction and development shall be prohibited <br /> within the site' s riparian habitat (as shown on Figure 3 <br /> of the Biological Resources Survey) and an area extending <br /> 100 feet from the edge of the habitat. The riparian <br /> habitat and its buffer shall be shown on the Habitat <br /> Management Plan, along with a discussion of activities <br /> proposed by the developer for the riparian area and its <br /> buffer. <br /> C. All construction and development shall be prohibited <br /> within 100 feet of the site' s open water habitat, fresh <br /> water marsh, and vernal pools (as identified in the <br /> Biological Resources Survey) . These habitats and their <br /> buffers shall be shown on the Habitat Management Plan, <br /> along with a discussion of activities proposed by the <br /> developer for these habitats and their buffers. <br /> d. Habitat elements (including native vegetation and snags <br /> in open areas away from buildings) shall be preserved. <br /> The details of habitat element protection shall be <br /> included in the Habitat Management Plan. Habitat <br /> elements shall be kept away from structures and managed <br /> so as not to create fire hazards. <br /> e. All habitat within the areas of dedication along the <br /> Mokelumne River and from McIntire Road to the river shall <br /> be preserved by the property owners affected by the <br /> dedications. A note to that effect shall be included in <br /> the Habitat Management Plan. <br /> Conditions of Approval - 7 - (MS-90-79) <br />
