DEVELOPMENT COMMITTEE MEMORANDUM <br /> MS-90-79 <br /> PAGE TWO <br /> 4 . To mitigate for the loss of native oak trees (valley oak, <br /> quercus lobata; interior live oak, quercus wislizenii; and <br /> blue oak, quercus douglasii) resulting form construction and <br /> other development on the site, replacement shall be at the <br /> rate of 5-to-1 (five oak planting sites for each native oak <br /> removed) . The Habitat Management Plan shall include the <br /> planting details, monitoring methodology, performance <br /> objectives, and remedial actions developed in the Biological <br /> Resources Survey that was prepared for this project. <br /> 5. All construction and development shall be prohibited within <br /> the site' s riparian habitat (as shown on Figure 3 of the <br /> Biological Resources Survey) and an area extending one hundred <br /> (100) feet from the edge of the habitat. The riparian habitat <br /> and its buffer shall be shown on the Habitat Management Plan. <br /> 6. All construction and development shall be prohibited within <br /> one hundred (100) feet of the site' s open water habitat, fresh <br /> water marsh, and vernal pools (as identified in the Biological <br /> Resources Survey) . These habitats and their buffers shall be <br /> shown on the Habitat Management Plan. <br /> 7 . Water levels in the open water habitats shall be maintained <br /> by continued pumping from existing pumps. The Habitat <br /> Management Plan shall include a note regarding pond levels <br /> and shall indicate the person(s) and mechanisms responsible <br /> for maintaining the pond water levels. <br /> 8. Habitat elements (including native vegetation and snags in <br /> open areas away from buildings) shall be preserved. The <br /> details of habitat element protection shall be included in the <br /> Habitat Management Plan. <br /> 9. A minimum twenty-five (25) foot wide buffer, in which all <br /> development and construction is prohibited, shall be <br /> established around all elderberry shrubs on the site. <br /> Elderberry shrubs and their buffers shall be shown on the <br /> Habitat Management Plan. <br /> 10. To grading (as defined by the Uniform Building Code, 1988 , <br /> Section 7003) shall be permitted within 0. 5 mile of a vernal <br /> pool unless the area to ge graded is determined, by a <br /> qualified biologist, not to contain California tiger <br /> salamanders. The details of limitations on grading shall be <br /> included in the Habitat Management Plan. <br />
