DEVELOPMENT COMMITTEE MEMORANDUM
MS-90-79
PAGE TWO
4 . To mitigate for the loss of native oak trees (valley oak,
quercus lobata; interior live oak, quercus wislizenii; and
blue oak, quercus douglasii) resulting form construction and
other development on the site, replacement shall be at the
rate of 5-to-1 (five oak planting sites for each native oak
removed) . The Habitat Management Plan shall include the
planting details, monitoring methodology, performance
objectives, and remedial actions developed in the Biological
Resources Survey that was prepared for this project.
5. All construction and development shall be prohibited within
the site' s riparian habitat (as shown on Figure 3 of the
Biological Resources Survey) and an area extending one hundred
(100) feet from the edge of the habitat. The riparian habitat
and its buffer shall be shown on the Habitat Management Plan.
6. All construction and development shall be prohibited within
one hundred (100) feet of the site' s open water habitat, fresh
water marsh, and vernal pools (as identified in the Biological
Resources Survey) . These habitats and their buffers shall be
shown on the Habitat Management Plan.
7 . Water levels in the open water habitats shall be maintained
by continued pumping from existing pumps. The Habitat
Management Plan shall include a note regarding pond levels
and shall indicate the person(s) and mechanisms responsible
for maintaining the pond water levels.
8. Habitat elements (including native vegetation and snags in
open areas away from buildings) shall be preserved. The
details of habitat element protection shall be included in the
Habitat Management Plan.
9. A minimum twenty-five (25) foot wide buffer, in which all
development and construction is prohibited, shall be
established around all elderberry shrubs on the site.
Elderberry shrubs and their buffers shall be shown on the
Habitat Management Plan.
10. To grading (as defined by the Uniform Building Code, 1988 ,
Section 7003) shall be permitted within 0. 5 mile of a vernal
pool unless the area to ge graded is determined, by a
qualified biologist, not to contain California tiger
salamanders. The details of limitations on grading shall be
included in the Habitat Management Plan.
