d <br /> -2- <br /> REASON FOR RECOMMENDATION: <br /> The Planning Commission heard this matter at the meeting as a consent item on July 5, 2007. <br /> The Planning Commission voted 4-0 to refer this item to the Board of Supervisors with the <br /> above recommendation. <br /> By State Law, the Board of Supervisors may grant tentative approval for cancellation on a <br /> Williamson Act Contract only if it makes one of the following findings: <br /> 1. That the cancellation is consistent with the purposes of the Williamson Act ; or <br /> 2. That the cancellation is in the public interest. <br /> Both of these findings include subfindings that the Board must also make_ The Planning <br /> Commission based its recommendation for approval on the ability to make Finding No. 1. The <br /> following is an analysis of that finding including the subfzndings: <br /> 1. That the cancellation is consistent with the purposes of the Williamson Act. <br /> a. The cancellation is for land on which a Notice of Nonrenewal has been served <br /> pursuant to Section 51245 of the Government Code. <br /> This subfinding can be made because the Community Development <br /> Department approved a Notice of Nonrenewal on February 15, 2006. <br /> b. The cancellation is not likely to result in the removal of adjacent lands from <br /> agricultural use. <br /> This subfinding can be made because the property to the east of <br /> this site is not under contract and only 4.4583 acres of land is to <br /> come out of contract. <br /> C. The cancellation is for an alternative use which is consistent with the applicable <br /> provisions of the County General Plan. <br /> This subfinding can be made because the cancellation is to facilitate a Lot <br /> Line Adjustment to move a property line that intersects an existing <br /> agricultural building. An agricultural building is a permitted use in the AG- <br /> 40 zone, and is consistent with the AIG (General Agriculture) General Plan. <br />
