i <br /> a <br /> Analysis <br /> Background <br /> On October 31, 1972, California Land Conservation Contract No. 737C1-12'was initiated for Assessor <br /> Parcel No. 241-350-29 (now 241-350-31 and 241-350=32), cointaining 57 gross acres. The.Community. <br /> Development Department approved a Notice of.Nonrenewal for•a 4.458 acre;portion of this parcel (APN <br /> 241-350-31) on February 15, 2006. <br />' On-site uses of the parcel include a single family residence, agricultural buildings, and an outdoor <br /> sportsmen's club. <br /> Department of Conservation <br /> Pursuant to Government Code Section 51284.1, the County must submit a notice to the Department of <br /> i Conservation and consider its comments prior to approving a tentative Williamson Act contract - <br /> cancellation. The notice must include a copy of the application, a copy of the contract, a description of the <br /> land, and a deadline for submitting comments. Such notice was mailed to the Department of <br /> Conservation on November 9, 2006. In a letter dated December 14, 2006, the Department of <br /> Conservation stated, "Provided that the information presented is complete and accurate, it appears that <br /> the Board has an adequate basis to support the finding required to cancel the proposed parcel of <br /> contracted land." <br /> Cancellation Value and Cancellation Fees <br /> The County Assessor is responsible for computing a cancellation fee for the property based on 12 '/2 <br /> percent of the current market value. Prior to giving tentative approval to the cancellation of any contract, <br /> the Board must certify to the County Auditor the amount of the cancellation. The fee calculation by the <br /> County Assessor is provided below: <br /> As is Current Market Value $33,000.00 <br /> 12.5% Cancellation Rate X .125 <br /> Cancellation Fee $4,125.00 <br /> The fee calculation is valid until May 10, 2008. <br /> Contract Cancellation Findin s <br /> The Board of Supervisors may grant tentative approval for cancellation of a contract on Williamson Act <br /> property only if it makes one of the following findings: <br /> 1. That the cancellation is consistent with the purposes of the Williamson Act; or <br /> 2. That the cancellation is in the public interest. <br /> Both of these findings include subfindings that the Board must also make.
